MEB Found me fit for duty.. and I'm not

I just went thru an MEB and found out the results yesterday.. They claimed me fit for duty - return to duty. The narratives (3) from the doctors that I saw at Wilford Hall TX all state that I am not fit and unqualified for world-wide duty and undeployable. It was a LOD (rotator cuff tear) with surgery and never got better. I cant even bring my groceries in my house.. Been on a P4 for over a year and very light duty for 3 years. I would like some compensation from the military, because I know that my unit is not going to retain me..I lost my slot and was put in an excess slot (due to unit deactivation) until my ETS, which is 3 Mar 10.. I have been in the Guard 31 years with 12 years, 7 months of Active duty.. Can someone advise me.. I wrote a letter of rebuttal to my PEBLO, which she told me to do. I am worried about my future and wonder what my chances are to have this decision reversed.. Any advice would be helpful.. Thanks..

    Do you mind me asking what your ROM measurements were from the PT? I too have had a shoulder injury, and had multiple surgeries. Did the MEB or IPEB find you fit for duty? I'm still waiting on the IPEB to return my decision... The local board doesn't think I'm worth retaining. Good luck!

    you can request an impartial review if it was the local/MEB level.

    Hi .. The ROM numbers are (Left Shoulder Flexion) 140/145 with bony block, whatever that means? (Left Shoulder Abduction) 112/115 with bony block... (Left Internal Rotation 90/92)... and (Left External Rotation) 75/77... the numbers are below normal, except for the Internal Rotation, which is 1 point above the norm... And I did request an impartial review this morning... I have no idea what this entails, but my PEBLO told me I could do it... Thanks

    Impartial review is having just that, a person unfamiliar with your case review it and make a recommendation. Sometimes the MEB members are "too close" to the case (since your PCM is usually on it) and might have pre-conceived ideas on how to proceed. It hurts nothing to have an impartial review at this point.

    the impartal review doctor called me this morning and (he's a LTC from Lackland AFB, where I had my MEB) and he told me that he does NOT CONCUR with the board's findings. What is next? Does anyone know? Thank you... Robbie

    Robbie, PM one of the moderators, your at a critical point in your process, if at all possible can you afford to hire counsel, Jason is a great lawyer, there is also a lawyer on the site whose handle is jackgately. you should fight it. fight it fight it. it's good the impartial did not concur, you don't have alot of time to act.

    mascabn - come to find out, the doctor that did the impartial review did not concur, he even made it worse.. reviewed my whole medical record and brought up all of my other medical conditions since 1979, saying that these conditions could be related to chronic pain... irritable bowel syndrome, have had depression since this whole thing started, hysterectomy has nothing to do with a torn rotator cuff... it was unreal... so i sent in another letter to the board, not concurring with the doctor's review.. he knows nothing about me except for what he read..... i think i'm on top of it... but it's not looking good... my PEBLO told me to keep fighting too... cant afford legal counsel, but PEBLO said that if i keep contesting it, she would provide legal counsel...
