Alright, so my husband is 100% VA and they took his Retirement away after receving his VA pay. We sent in documentation for CRSC serious Asthma and PTSD. They told him Asthma is 30% and he doesn't get anything due to the offset for VA. He was in 9yrs. They just sent him another denial letter telling him they don't have enough proof for PTSD. We sent in his Army Accm. Medal but they are still staying not enough proof. How in the hell are you supposed to show proof. He got 70% just though the VA alone for PTSD. He is so upset and I don't know who to turn to for help. We have a 4yo and another baby on the way. Thank you anyone who can help me out!

what was your husband's MOS (what did he do in uniform), and where did he serve? In other words, what caused his PTSD?
 
If your husband has the Purple Heart (PH), then he should also have the Combat Action Badge (CAB). Unless his medical records show that the PTSD is for something unrelated to combat (e.g., a fatal car accident he came upon in Georgia) than I would think it would be presumptive for PTSD. Appeal to the Army Board for Correction of Military Records. When you appeal, know they do not obtain the service records. So you have to provide the DD Form 214 and all supporting medical records.

This is what PI$$e$ me off to no end.

The fact that the SM has to OVER and OVER and OVER again - DOCUMENT - DOCUMENT - DOCUMET.

GOSH! One would think that every crooked bend in this road - the ARMY/DOD ALREADY HAD ALL THESE BASIC RECORDS.

Else, WHY - OH KEEPERS OF THE RECORDS - THE US ARMY - they continue to make this a pain in the rear-end!

THEY are the 0nes who deny - THEY are the ones who hold all the records - THEY get the rationale to DENY BOTH ways.

JE$U$ AND HOLY COW! - how can you even get a square deal - FROM JUMP STREET?

Actually, the National Personnel Records Center, GSA, has your paper records after you are discharged or retire. Of course, iPERMS is accessable to the BCMRs. But the big thing is the medical records and by agreement with VA, all military medical records are forwarded to the VA Regional Office with geographical responsibility for your HOR at the time of discharge or retirement.

So actually, the US Army is NOT the keeper of your military records.

Dear Ed:

Glad you mentioned that geographical responsibility piece with the VA. I just realized that when the VA kept sending correspondance to me via an incorrect address, that that incorrect address would also fall under a different Regional Office. It may be possible that my correct VA Regional Office may not be holding any of my forwarded military medical records.

Hmmmmm.... How do I make sure (verify) the correct VA Regional Office has my forwarded medical records?
 
Call them and ask if they have your medical records. You'll probably get forwarded a couple of times, but patience and persistance will pay off.
