Default AF RILO

I received a call Friday from the PEBLO office stating AFPC needed a "Commanders Letter" for a RILO. I am not really sure as to why the MEB changed to a RILO and what are they trying to do? Maybe someone can help me out.

Here is my situation:
Apr 03 - Assigned to a geographically seperated unit.
Sept 04 - Car Accident.
Sept 04 _ today - Treated for bulging disc, neck pain, weakness
in arms, and Trigeminal Neuralgia the past 3+ years from auto
accident.
Feb 08 - Received an assignment with RNLT date of Aug 08.
Mar 08 - Civillian Neurosurgeon says I need to have cervical spinal fusion
on my neck.
Apr 08 - Went to Military doc's (5 hrs away) at Commanders and 1st
Sgts request to update military records, doc says I need MEB for
the Spinal Fusion, Mil Doc put me on a profile and wants me to
come back to see him 6 months after surgery, he stated my
assignment will also be cancelled because of the profile.
Apr 08 - Mil Doc contacted me and said local MEB will hold off on the
Spinal Fusion MEB until after surgery but will change current MEB to
Trigeminal Neuralgia.
May 08 - PEBLO contacted me and stated AFPC needs "Commanders
Letter" and are doing an RILO.

I am currently at 18y 4m of active duty service. We were to PCS in June but military doc says my profile will cancel my assignment. I have not seen the assignment cancel as of yet. I have not had the surgery because I have been trying to find a home for my family because our houing is closing in June due to the BRAC (army housing at guard base). According to the surgeon my recovery will put me out of work for 2-6 months, no driving for up to 3 months with possible full recovery of up to a year. The PCS was perfect timming for the base closure but now with the length of recovery I will need to find a temporary home. The Army will not pay for my move because I have a pending assignment. I cannot find a place to rent for month to month as everyone wants a 6 month or 1 year lease. I am so stressed! What do you think is behind the MEB change to a RILO? Whay has AFPC not cancelled my assignment? Is AFPC using the RILO to possibly cancel my assignment or look at the possibility of sending me on the assignment while I am on convalecent leave or continuing the process of the MEB? What will the commanders letter AFPC wants do? I need either the assignment cancelled or at the least have my RNLT date pushed back until I am cleared by my neurosurgeon. Whatever happens I hope I can get to 19 so I can drop my retirement.

You can ask your PEBLO to see the paperwork and it will say if it is a RILO or MEB. However RILO are usually done on people yearly after a MEB. It is to see if your condition is worse or the same.

As for housing, have they gave you a 30 day noticed (all month to month leases have to give you 30 day notice before they "evict" you. If your forced to move from housing, the miltary has to pay for your move. Maybe you can get a waiver or something and move in to TLF. Talk to your shirt about your housing situation.

If you have to get housing on the economy and sign a lease the law states that military orders allows a member to get out of the lease w/o penalty. It is covered under the USERRA law. Those doing leases are most likely aware of this.

You can get out of any lease(any one can), however there are penalties. If your saying there is a federal law that states military members are exempt from these penalties upon receiving orders, please post specific reference.

The lease provisions are found in the Servicemember's Civil Relief Act. Here is a simplified explanation: Servicemembers Civil Relief Act (SCRA)

Not sure this will apply to you, your orders may or may not qualify depending on what happens. What you should do is go to Legal Assistance to ask about this, this is the kind of stuff they do all the time. Plus there may be state law protections that can also help you.

It seems with a RILO you are more likely to remain on active duty. This is a good thing for your benefits; if you can make it to 20 years, you will be eligible for Concurrent Retirement and Disability pay (basically you will be able to double dip on military retirement and VA compensation).

Ray,

Just trying to help! Those two laws are often mixed up as the tend to impact Guard and Reservists more often than active duty folks (due to the frequency of orders being issued affecting pre-military service debts and obligations).
