would this condition be rated?
I'm back for more info.
Background:
Army injured in OIF 11-07.
Conditions:
1- Spondylolisthesis GRII, Severe Spinal Stenosis and Radiculaopathy with mild atrophy in rt Anterior Tibialis. Had Bi-level fusion (L4/L5/S1) this summer. My fwd flexion is about 30 deg. I am being boarded for this and anticipate a 40% if they go by the VASRD.
2- I have recently been diagnosed with "obstructed bladder" or neurogenic bladder. Basically this is where you retain urine after "urinating." This keeps you running to the head as you never get empty.
The rating code I found that addresses this is 7542. My post-residuals were 320 cc. Now I am on medications and will always need to be. This has fixed the problem for now. My DR says this condition is secondary to my back injury.
?????????????Question here is if condition #2 is ratable? The medication handles it, but to my knowledge, the VASRD does not state whether or not successful medicinal treatment makes it non-rateable.
One more situation:
I am an Army officer w/ 4.5 yrs commissioned service. I have 14 yrs prior enlisted service. In total, I have about 9 yrs active duty service.
For a disability retirement, I understand they basically use your rating percentage times your current monthly base pay.
??????As for what rank/grade one retires as, I have heard (cant find the answer) that if you are prior enlisted, you may only retire as an officer if you have at least ten years commissioned service. If not, you are reduced to the highest enlisted grade previously held. If this is true, does this apply to disability retirements?
