Default Injured In Basic Stuck in Limbo

My son has written and is asking me to find out information on the MED board process.

He enlisted in the Army back in June and received a medical waiver for a condition of his legs (he has calcium depoists ) and everything was going very well, he loved the Army and then he broke the small leg bone where it attaches to the ankle.
The docs saw his legs and decided to send him home on a pre existing condition discharge. He did not want to leave so he argued with them telling him he had a waiver and he just needed to heal and then continue his training.
Now they are going med board, and the docs are still telling him he cannot stay.
His questions are:

1. How long does the process take? Some guys have told him it can take two years and he is concerned about being stuck in that limbo where he has not graduated basic yet for that long. Is this possible?

2. If the med board say he is not fit for duty does he have any recourse after that to attempt to stay in?

3. If he is able to take another MOS but his scores are not high enough would he be allowed to retest?


His leg has healed and he says he is in no pain, he is able to walk and run and dance and he wants to either stay in his current MOS (infantry) or switch to another MOS (combat related).

Not rteally sure if they are going to do a real MEB. Because in basic, your really not in the military yet. They might just cut him from the folds, as if he was never in.

They should do a MEB on him if he his condition is incurred on orders for 30 days or more (it is the length of the orders, not the 30 day mark that is important, i.e, the 1st day of orders that last 2 years counts...the 29th day of 29 day orders does not, but there are other possible eligibility reasons that might cover someone in this situation).

I have had clients in basic training before. The main issue is likely to be whether they say his condition Existed Prior to Service and was not service aggravated.

As far as recourse, after he is separated, he could apply for Board for Correction of Military Records.

I think you are asking if he can reclass his MOS from basic training without having completed his initial MOS training. I think the easiest way for him to explore this is to talk to the retention NCO in his unit.
