Default Retirement and VA package

After talking with the retirement person on base (we got our retirement date) and with the PEBLO have lots of questions. The PEBLO told us that once we hit our retirement date that his VA package and medical records will sit in the retirement office for 7 days before being sent up to VA. The retirement lady said that the VA package and medical records sit in the retirement office for 30 days before they are sent off to VA. A separate lady who works for the VA and helped us fill out our paperwork said as soon as we have a retirement date and a DD214 and a copy of the medical records, she can mail off our packet. Which is correct? That's three separate stories all from people who should know what the story is. I don't want the package to go to VA and just sit because it's not the "official" copy. What is the REAL story?

Go with the VA lady, she is correct. All the VA needs is a
1, Retirement date
2, DD-214
3, Medical Records (send them a copy, keep your records yourself)
4, Your claim

if you have'nt already, i would HIGHLY suggest that you take sometime out of your day and stop by any of your local vets agancies, like the VFW or DAV so that way you ensure your claim is filed way before hand. i did mine over a year ago and i'm still awaiting my IPEB. good luck!

That all sounds like real bad gouge.

There is a pre-seperation guideline, for any memeber who is within 180 days of retirement to file a claim. You may be at a BDD, Benefits Delivery at Discharge site, but even if you are not you can file your claim now, knowing you cannot receive benefits until after your retirment date. M21-1MR has the VA processing procedures and part III discusses seperation claims in detail. I am fairly certain from what I have read, and people I have asked, they can recieve it, process it, and rate it, they just cannot finish it until you officially retire. If you cannot locate it in the VA regualtions look up Fast Letter 07-09.

Just to ensure, I was not talking about what Robs42 said. But what you were told by the others. When I went to TAPS and I asked about the pre-seperation claim, the VA rep was unsure what I was talking about.

Do you know what section in part III is about BDD, my local VA seems to know nothing about this.

Retirement date is Sept 25, PTDY starts July 26 and lasts for 20 days, then he takes 42 days of leave, so basically we should have a DD214 in hand on July 25 if I understood everything. BUT the retirement services at Fort Lee will not send the "official" copy of his records to VA until October 26 or later. We went to PNMC and the lady in the VA office at the hospital helped us fill out all of our info andput in the official retirement date. She siad to bring her the official DD214 when we get it, but she already mailed our claim out with a copy of his out orders. Fort Lee says it will hold up our claim sending the DD214 separately, but she said no. The funny thing is Fort Lee says the Army reg is there so everything can be put in his record for medical appts. he has ongoing during the terminal leave, but Ft. Lee doesn't even have access to half of his records, because they are psych records that stay at PNMC. The lady at PNMC does have access, so basically Ft. Lee even if they wait will have an incomplete record where Portsmouth has a complete record. PNMC says they can start the VA physical process with what they have. I feel much more confident with Portsmouth people, but I'm scared Ft. Lee is going to screw something up like normal.

jim 1960, M21-1MR, Part iii, Subparti , Chapter 2, Section A and B. General information on pre-discharge claims overview.

Explains types, including TDRL, PDRL, Serios Injury, very serious, and the BDD, and how BDD should handle claims, including the possibility of seperation date changing. Discusse GWOT, OIF/OEF, receiving priority handling, all that stuff.

At least 1 day, but no more than 180 days left on active duty.

It give a pretty clear idea of what claims should be handled, and how, for members still on active.

I was told I could get my DD214 processed and received while on terminal, we will see, and I am not holding my breath. But I did receive an official message from PERS that confirmed my seperation date. The VA can check multiple places
