Looking for an update
I know it hasn't been very long in legal terms since I checked before (about 4 months) but I was wondering the status on the fight to prevent the Navy and the Marines from giving sailors/soldiers an Administrative Separation for medical reasons.
My husband was diagnosed with Crohn's and after four months of care and medication has had no flares. Repeated tests show that it is very well controlled with medication. The Navy has no specific wording on re enlistment or retention with regards to Crohn's however the Army states that if it is well controlled that re enlistment and retention are possible. However my husband's GI doctor is telling us that the Navy pretty much gives people with Crohn's the boot regardless if it is controlled or not. Because of his symptoms he probably will not meet the 10% disability rating with the VA. This makes us concerend that he will be one of the cases given an Administrative Separation for medical reasons. He wants to re enlist however there are several factors that are working aginst him. He only has 5 years in, and he is enlisted not commisioned.
What is the best way to go about presenting a case to stay in. (does he even have a prayer) Is he shooting himself in the foot by fighting to stay in and proving his fitness and then possibly having to turn around and prove his unfitness medically to fight for a medical discharge rather than admin sep?

Edit: in addition my husband wanted me to ask. If he is declared fit is he going to have to worry every re enlistment and change of command that the command may decide he isn't world wide depoyable and give him an admin sep? That isn't something he wants hanging over his head for the rest of his career.
