I never posted here, but I'm trying to see if requesting a Formal PEB would be worth it. I've been in 17 1/2 years, and I'll hit 18 years in July. I was told that I was found UNFIT by the PEB and I'm just waiting on my findings. I only had one referred condition which was Fibromyalgia. I am a YN in the Navy (Admin) and I am still able to do my job. What would I be able to tell the board that would make them change their mind about my findings? I know the rule of deploy or get out, but I don't see why that would affect my chances of being able to retire in two years. Would I be able to request a FIT finding with restrictions? Basically stating I can do my job, but remain in a Limited Duty status until retirement? Is it even worth fighting to get a FPEB if they will just tell me no because of the new policy? Any help would be appreciated.

I would delay, delay, delay. I would request a FPEB and then consult my attorney regarding a strategy.

request a FPEB and continue to delay the FPEB, if that makes sense. once you request a FPEB, they will assign you to a lawyer - like chaplain said above, get with that lawyer and see how to strategize a way to continue delaying the FPEB. my husband is an IT in the navy and suffers from migraines, but is unable to do his job due to the added stressors the military brings

Welcome to the PEB Forum! :)

Indeed, a FPEB hearing could potentially result in the continuation of your military service career if a favorable outcome is determined.

Albeit, you should initially evaluate your entire IDES case file particularly with the assistance of an IDES attorney for recommendations upon the immediate receipt of the IPEB findings. Take care!

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer!"

Best Wishes!

An FPEB can be appealed. But delay everything you can lawfully/procedurally delay.

Normally I’d tell you delay but if you already have PEB findings, you are already halfway through the program. It is unlikely that you can delay only the latter half to get all the way to 20. You’ll definitely hit 18, but sanctuary does not apply to PEBs. I’d say delay simply to get more of your high 36 months a little boost.

I absolutely do recommend requesting continuation so you can hit 20.
