100% VA and 100% military????

i receive $3,465 from the VA monthly. I just received my results from my PEB for 100% but haven't talked to my PEBLO yet. I have 16 years active and an additional 3 years and 9 months in the National Guard. Will I receive any additional payments?
 
If the PEB rated you at 100%, then you would be eligible for a medical retirement of 75% of your retired pay base (average of your top 3 years pay).

With 16 years active and 3 years 9 months of NG/reserve time, you may be short of the 20 years required for a reserve retirement. It is very important to look at your RPAS statement and calculate the points. Since you may be just short of the 20 years, you may want to look at you case and see if an error was made which would warrant an appeal.

I am not an advocate of delaying the process without just cause, however many cases have issues/errors/omissions that can be appealed.

Based upon this timeline your have presented, it could mean the difference between receiving your reserve retirement at age 60 or not.

IF you went through IDES and got above 30% DOD, your retirement starts right away, not 60 years old.

The answer is you might get something from DOD In addition to VA. I was an O3E over 20 for pay 18 active and 2 reserve. I had maxed the high 3 at the O3E pay scale. I was awarded 100% VA and 100% DOD just like you. DOD can only pay 75% which was mentioned in a previous post. My 75% came out to 4732 per month. I got 3268 from VA... I must have one less dependent than you because yours is just a little more VA than mine for the same 100%. So here is the breakdown:

DOD max = 4732
Minus VA - 3268
= 1464
Minus SBP. -307 (survivor benefit plan)
= 1157 from DFAS monthly

so I get two checks a month one from VA for 3268 and another from DOD for 1157. As my children turn 18 they drop off the VA and my VA goes down to the single rate which now is 2900. At that point DFAS would make up the difference to get me back up to the 4732 total.


This means that you'll only get paid retired pay by DFAS if your high 3 or points at your paygrade are higher than the 3465 you get from VA. I could have opted to just received all of my 4732 from draw and nothing. From VA but it would have been taxed that way, so I opted to have it split up.

If you have a single 100% rating and an additional 60% in combined ratings the VA pays you a tad extra.

Would my DOD ratings drop if VA ever decided to drop my ratings. My DOD ratings are all service connected and combat related. would I be eligible for CRSC. would my pay be ta free or taxable. Anything else I need to know in my case. any help and clarifications will be greatly appreciated.

In response to your inquiry, I offer the following information:

A1. Technically, no albeit DFAS and DoVA would have to jointly agree on any potential changes in my opinion.

Q2. My DOD ratings are all service connected and combat related. would I be eligible for CRSC.
A2. Yes.

Q3. would my pay be ta free or taxable.
A3. CRSC and DoVA compensations are non-taxable income. DoD pay is taxable except if a combat-related determination was awarded.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer!"

So you're saying with the IDES process, and given 30% or higher DOD rating, a person would get their monthly military retirement payment right away, and the monthly VA rating payment also? Or only if the member retired with a full 20yrs AD? My question is would member get both if not a full 20 yrs AD at time of....
 
Apples and oranges. 30% or greater it starts right away, no waiting till 60 even if under 20. VA plus DOD retirement will require CRDP or CSRC, if not it's a proration you can find in other threads.

Here is my question:

If the DoD permanently medically retired someone for a single condition at say 70%...is the VA allowed to rate the same exact condition at a lower percentage in the future?

Simply, does the VA have to honor the DoD rating and offer compensation for that same condition at the same percentage? Or is it entirely possible for someone to have a DoD rating of 70% and a VA rating for the same exact condition at a lesser percentage, say 30%?

I've always wondered this and someone asked me and I couldn't find the answer. My gut instinct says that the VA does NOT have to honor the DoD percentage and can rate the same exact condition as they see fit.

Has anyone ever run into this before?
 
DIfferent idea, same topic. What if the VA is making you pay back a separation bonus, would the DoD then raise your payout (Seeing the DoD retirement is higher than my VA) so you were back to normal amount? I know it wouldn't be tax free but the # would be the same?

Sir a quick question. Can I still work even if I get 70% or more from DOD disability and 100% from VA disability? I heard people cannot work in civilian when they get 70% or more from DOD. The ratings are not out yet but it is very important for me to work after getting out. Please help me.

Yes, you can work. If you are getting 100% VA TDIU (Total Disability Based On Individual Unemployability), then you can not, and you would lose the TDIU benefit, but only after returning to work full-time and maintaining substantially gainful employment.

Thank you so much for you instance response. No i will not get 100% based on unemployment. I have 4 P3 and i heard i cannot work when i get more than 70% from DOD. I want to remain working.
 
You can work but there could be circumstances such as a 100% mental health rating they may question of your rating is correct if you can work.

No, I have Lower back, right knee, left wrist and fibromialgia referred condition. Nothing referred for mental health. I just want to remain workable. Thanks for your response.
