Future appointments for PDRL

I was found unfit for Lumbar DDD 40%.

On the findings sheet from the board under #12 it states the disability is permanent.

Under the reasons for decision from the VA each and every condition (including my unfitting one) it states "Since there is a likelihood of improvement, the assigned evaluation is NOT considered permanent and is subject to a future review examination."

I was under the impression that going to PDRL required no future appointments. Is this the case for only my unfitting condition or should it also work for all my conditions.

I keep reading horror stories of people getting lowered for a multitude of reasons.

Remember, DoD and VA are separate. If placed on PDRL, you will not have future DoD evaluations. However, it looks like the VA has decided your conditions are not permanent. You may undergo reevaluations by the VA for VA purposes, not for DoD.
 
You are locked into your DoD percentage, but not your VA percentage. you can appeal and ask the VA to make your ratings permanent. My conditions were different, but I appealed the temporary ratings and 7 months later my temp ratings were made permanent.

Did you appeal during IPEB or after you were out? It's too late for me to appeal as I have already agreed with the findings.

Hi there, what form did you see that broke down the VA decision for each rating? I don't recall seeing anything like that. I signed my form that said I was permanent retiring, but I'd like to know if I'm going to be subjected to future evals as well.

Your proposed VA rating can change between now and when you retire. Within a few months after retiring your VA rating will be finalized. If conditions are considered permanent, your VA award letter will state that conditions are permanent, use certain language about no future reevaluations, or provide benefits specific to permanent findings.

Thanks for the info! Sure is panic inducing, though. Based on what you've said, even though I'll have been retired, the VA can change the ratings so that would mean that it could change to less than retirement and then what? I get recalled back to active duty? I'm already on terminal leave. I think I'd lose my shit if they decided to change it while I'm on terminal. But if there's a way for me to get screwed, I'm sure it'll find me.

I appealed after I was out. It can be done before using a VARR.

If your future VA rating changes your DoD won't.

Thanks! I went thru all of my paperwork again, and I don't think they'll change it at this point. Perhaps I can will it into existence. :)
