CRSC at ten months processing time Army

Filed my CRSC claim in September last year. Since I never heard back I called them a couple weeks ago. After two calls and couple emails, finally was able to talk to a Supervisor at HRC. She informed me that "Several CRSC claims were lost or degraded, due to some glitch with their computers". I refiled my claim this week, and from what she says it will be "Expedited for a determination". So FYI to all, if you haven't heard from them in a while, it may be in your best interest to follow up and call them.

I filed a claim for CRSC in March of 2017. I forgot about the claim and finally received my approval letter around May 1st. The letter was dated April 25, 2018. I have an efficient date of June 2014. DFAS CRSC statement show my first payment will be on June 1st. The reto payment I have no clue how long that will take to get.

Update on my backpay, I called DFAS and spoke to a level 2 person, and they said they began processing my back pay on May 18. so it shouldn't be too long until I'm in Bora Bora

final update... retro pay stub showed up on mypay under crsc payments on 14 june 2018, payment date is listed on the stub as 19 june 2018.

How far back do they go for Retro pay? My claim is at 10 months!

I heard it goes all the way back to your effective date of VA award any information on this?

For me it was retirement, i went from active duty to the guard... I received va while in the National Guard. So i couldn't speak intelligently on it.

CRSC replaces some or all of waived retired pay.

One has to be in receipt of retired pay (or eligible for it if already waived) in order to receive CRSC and waive retired pay dollar for dollar in the amount of VA comp.

The earliest date a regular retiree could receive CRSC is for the month following the month he/she entered into a retired status. It is associated with receipt of VA comp and waiver of retired pay.

--Regular retirees enter a retired status only on the first day of a particular month. Consequently, the first date that retirees could accrue VA compensation is the first day of the following month (if the VA comp was effective the day the retiree entered into a retired status). EXAMPLE: My last day of active duty was 31 July 1991...I entered into a retired status on 1 August 1991 and my VA comp was effective the same day, albeit retroactively. The first month for which I accrued VA comp was for 1-30 September 1991 which would have been paid on 1 October if in real time. The first period of eligibility for CRSC was for the period 1-30 September 1991.

--CH 61 retirees can retire any day of a month. Therefore, CH 61 retirees can begin to accrue VA comp on the first day of the month following last date of active duty even if that following month was only a few days distant. EXAMPLE: Doe retires on 28 July 1991; he/she can receive an effective date of 28 July and begin to accrue VA comp for 1-31 August (note the difference between CH 61 and regular retiree). CRSC would follow suit if approved for the 28th of July.

Month After Law

Ref: https://www.law.cornell.edu/uscode/text/38/5111

"... payment of monetary benefits based on an award or an increased award of compensation, dependency and indemnity compensation, or pension may not be made to an individual for any period before the first day of the calendar month following the month in which the award or increased award became effective as provided under section 5110 of this title or such other provision of law."

Can anyone elaborate on whate the SMC date is for, and if that is the same as CRSC?

The back pay only dates back to the date submitted for CRSC. This pay has nothing to do with the VA process other than using the medical findings as evidence.

I think you have misinterpreted the process or I have misinterpreted your remark.

The effective date for CRSC is rarely, if ever, the date submitted for CRSC. I have yet to see an approval using the date submitted as the effective date. ( I have "worked" many CRSC cases from 2010 forward at another site.)

Most CRSC approvals are based on the effective date of a VA award and the DFAS will use the date shown as effective date for CRSC per the service CRSC board's letter of approval. One must waive retired pay for CRSC eligibility.

I have received retro CRSC on a couple of occasions and the retro date was NOT the date I submitted my CRSC application.

For some reason, I could not read your attachment. In any case, it appears you have a question pertaining to SMC and CRSC.

Per the Army:

"Will Military Service Retirees receive additional Combat Related Special Compensation (CRSC) funds if entitled to a Special Monthly Compensation (SMC) from the Department of Veterans Affairs (VA)?"

Answer: "Possibly, CRSC evaluates whether a Military Service Retiree's SMC is awarded as combat-related. The CRSC legislation stipulates that only combat-related disabilities will be considered when re-evaluating Military Service Retirees' CRSC rates. The gross monthly amount of CRSC cannot exceed the gross monthly amount of retired pay, regardless of SMC determination. For instance, if the Military Service Retirees current CRSC payment is already equal to the applicant's gross monthly amount of retired pay, no additional money is due."

---

Here is an excerpt from a post I made in 2016:

"My CRSC statement for 1-31 July 2016 (payment on 1 August) shows "CRSC Special Monthly Compensation Code 49." I have SMC-K and SMC-S. My most recent CRSC approval specifically shows SMC-K and SMC-S as combat related (codes 01 and 049) and the effective dates. This approval was in April 2016."

I called HRC this morning, been waiting for 1 year and 15 days now. They're saying the CRSC wait is now 13 months processing time. They apparently only have 3 people that are able to approve the packets. The wait unfortunately continues.

Submitted on 5 June 2017 and received my letter via HRC website on dated 8 June 2018. DFAS said that they received the letter on 12 June 2018. The waiting continues.

13 months? Holy shit.

They told me 10 months, 1 year, now 13 months.. :p
