VA rating null and void

Throughout the MEB process, the VA proposed a 70% rating and then I was approved for Limited Assignment Status and allowed to retire this summer with just over 20 yrs. The letter from the VA says "In the event that the member is not separated from service as a result of the IDES process, this rating is null and void for the purposes of entitlement to VA benefits."

So it sounds like I'll have to re file my claims and go back through all my C&P exams. My question is...does the VA retain all of the medical records that I had to provide that led them to propose the 70% rating from 6 months ago, or do I have to go back through records as if it were day 1 in the claims process?

I went through IDES and although I never saw those words, I was informed that the IDES rating is a “proposed” rating and that once I was out it would’ve looked at again for a “final” rating. I think this happens in all cases. So I had to wait two months after I was out to start getting VA comp, due to the finalizing of the rating and DFAS/VA hashing out how much each would pay.
 
Since my proposed ratings were dated Oct 2019, does anybody know if they are just going to update the ratings, or put me all the way back through the ringer with ratings having recently been done?

Was your proposed rating the same as your final rating? Do you know if it’s generally the same for others or have you heard of others getting something totally different? I’m fairly new to the site and haven’t seen much about this.
 
Yes my final rating was the same as proposed. I haven’t heard of anyone whose final rating being different.
 
It's unlikely to change because the proposed ratings will generally use the same information (mainly C&P exams), they should not change.
It's possible they may order additional exams if they are deemed too old. Assuming you will be retired in a few months, you should be okay.

I retired slightly over 1 year from my C&P exams without a need to do all over, just a handful of "deferred issues."

The VA will have all exams on file, so your claim doesn't "start over"

Once the DD-214 is on record, your ratings are finalized, your award is authorized, you will receive compensation accordingly.
 
what does it mean when PEB accepts your case... does that mean you were stated unfit... also when should I receive my rating back if so...?

I have a question so my status changed to preparation for decision on ebenefits does that mean anything?
 
Usually means they have made a preliminary decision and are putting together the evidence, sometimes it goes backwards if they need something else. I don’t put too much weight on it if you’re going through the med board process cause mine went to that in February and I’m still waiting. Hope yours goes faster
