Too long & Unorganized

I only ever had 1 claim and it's still open and pending. I was hoping that since they're already in DEERS it would transfer over to VA
This is what my claims look like on va.gov and ebenefits. Those dependency claims weren’t there from the beginning so I think they showed up the same time as that closed claim on va.gov, even though ebennies shows them as pending.

Yeah I wouldn’t worry too much about adding dependents. If they’re not in there automatically when your PEB and VA rating are finalized, then it should be pretty simple to add them. Your peblo will probably just tell you the same old “hurry up and wait.”

Mine says that as of March 29, 2021 for the open and closed but I still haven’t heard anything.

Anything is possible but typically the proposed rating will be final once you get out and give the VA your DD214. I would not expect the rating to change:)
 
21OCT21- I received my findings.
DOD- 60%
VA- 100%
I submitted a complaint through my congressman's office and received an initial BS generic reply from the Navy and asked them to file a rebuttal calling the Navy out directly. I am not sure if this helped move my case along but today the Department Head of Medboards contacted me to inform me of my findings vice my PEBLO. He also stated that he recieved quite a stack of findings today!

If you don’t mind me asking, how exactly did you go about submitting a complaint through your congressman?
 
Sorry, all I was at school and realized my messages didn't make sense to some. So here is the full run down. Hope this helps let me know if you have further questions!
I wrote to my actual congresswoman from CA (because I am a CA resident) and then to my husband's congressman in Florida (we are dual active and he is a Florida resident). Senator from Florida office put in a formal inquiry and then the Navy responded with a BS general reply and blamed the majority of the issues on me. So I took the time to go through every item and call them out for what was wrong and asked the Senators office to rebuttal on my behalf. I am nearly positive it helped me because my timeline is far behind others and my PEBLO is no longer my PEBLO, the DH has my paperwork. You can jump on their congressional website and request them to file an inquiry on your behalf or call them. They will have you sign forms and ask for a basic situation as to what is going on and what you want them to help you with. Explain to them in detail because they have no clue about the process or how it works.

This was what I initially sent and I attached screenshots of e-mails from the peblo, the VA where it showed all my case timeline information, and anything else I could think of.

This is the initial complaint:
I expressed my concerns to my PEBLO, (PEBLO), several times about the length of time my case was taking. My concerns came from having watched my peers advance through the process at a faster rate and have been retired or are nearing their retirements dates, a step that I should be at as well. But I am not. After speaking with (PEBLO) yesterday, I was finally able to speak to a supervisor after MONTHS of voicing my concerns and after finding out I had been extended yet again for another 6 months. Ultimately, the supervisor greatly apologized for the errors made in handling my case, but I was told that there was nothing that could be done to right the wrong. The errors on (PEBLO) part come from not completing my NARSUM in a timely fashion (this should have occurred in February or March) and then not submitting my package upon my agreement and signature (I signed finally on May 27th and my paperwork was not forwarded to D.C. until June 12th). Again, I have several friends going through this exact process and have not had to endure the hurdles that I have because their PEBLO’s have been their advocates and accomplished their cases in a timely fashion.

As I mentioned in my request for help, I am in Nursing school and have been since May because I was told my case would be completed at the latest by August. I also did this to set myself up to complete school by the time my husband is set to transfer likely down to the Destin EOD Schoolhouse. I am supposed to start school nearly every day full-time come September 8th but there is no way this is going to happen. The PEB is backlogged and because of the mistakes made in my case from the beginning, I am now stuck in line waiting 6 months to get my results. Stuck behind hundreds of cases that I should have been in front of. It is frustrating beyond belief, and I am watching my hopes, goals, and dreams fade while I am stuck waiting all because someone didn’t do their job. I am a United States Sailor, a mom to 2 little girls, a spouse to a U.S. Navy EOD Tech and I am a straight-A student. Before I drop from my upcoming classes I wanted to ensure I exhausted every avenue to correct this wrongdoing. I was told that the PEB office can submit a memo to expedite the process, but they are unwilling.

For reference, my timeline is as follows:
  • MEDBOARD initiated 29SEPT2020
  • VA Appointments completed 15DEC2020
  • And then I wait to sign my NARSUM that was copied and pasted from my medical record until 27MAY2021.
  • On 12JUN2021 (PEBLO) finally sends my paperwork to PEB in Washington D.C. two weeks after I signed it.
Also, due to the length of time that my Medical Board has taken, I have had to sign two retain-in-service extensions. The extension this time was not imputed in a timely fashion due to PSD rejecting the initial document and no one from my command followed up. I am now without pay and health insurance. There are three systems in the Navy is what PSD is telling me. On the personnel (NSIPS) system my date is correct but in DEERs for health insurance and DFAS for pay, the new extended date does not reflect. Therefore, I have no paycheck and no healthcare. I am being forced to pay out of pocket for our healthcare needs which are going to add up quickly when I am also not receiving a paycheck. My daughters are getting ready to start school and need physicals, but I cannot afford to just keep paying out of pocket. My daughters also take daily medications that NEED to be refilled but I cannot afford to pay out of pocket. My daughter has asthma and allergies and needs life-saving and preventative medications but again I CANNOT afford to continue to pay out of pocket and I refuse to because these are my basic entitlements! I need help.

I have taken a moment to review the response provided by Captain Perkins and found several discrepancies.

My case was not delayed by only two weeks, it was delayed by several months. The enclosure (1) that Captain Perkins provided does not explain the months-long delay in processing my case from his office rather explains the future delays that I will be facing as a result of his office's mishandling. I will go on to face further delays at the Physical Evaluation Board (PEB) level and that is was said memo is referring to.

Also, the failure to update DEERs was not on my part. The medical board office at NMCP failed to properly submit my case to PEB in a timely fashion as a result, I ran out of time on my contract and was retained in service for another extended period. This should not have occurred or I and my command should have been notified about the increased timeline of my med board package by my PEBLO. However, we were not notified, so when my command submitted the extension paperwork, it was denied because (PEBLO) told (PSD lady) at PSD that I would be facing a longer timeline and to extend me for 6 months vice the 3 months that I had signed for. Neither Mrs. Basil nor Mrs. Duvall told anyone about the discrepancy and as a result, the pay and DEERs system did not update. I had a lapse in pay that has since been fixed. I had no medical coverage for MYSELF or CHILDREN for several weeks and that too has since been fixed because my Commanding Officer reached out to the My Navy Career Center.

Again, I have lots of documentation to prove all of this. I don’t appreciate Captain Perkins’ attempt to place the sole blame for this entire situation on myself and his attempt to minimize the delays in my case by stating that they were a mere 2 weeks when this is not the situation at all. Though my pay and my medical coverage have been restored, I still feel that it is important for Senator XXXX office to get to the bottom of said delays in processing not only at the MEB level but at the PEB level as well. I sent my timeline but I feel the need to reiterate it so that someone can recognize the gaslighting that is occurring in this response.

My MEB began on 29SEP20
My paperwork from my VA appointments was complete and sent to my PEBLO on 15DEC2020
My package was not submitted to PEB until 12JUN21

Therefore, I was in the MEB phase for nearly 9 months when this portion of the phase should take NO more than 72 days per the 2018 MEMO I have attached regarding Medical Boards. I am just shy of 365 days, so how does anyone believe that there was only a two-week delay? I truly hope that this is investigated further and that your office is able to see the holes in this shoddy response.
