20% is better than 30% or higher.... prove me wrong

Same for me, I've received 2 payments with nothing recouped. One unfitting condition (20%), but I was rated for 19 total by the VA so I'm easily at 100% without the unfitting condition.

Do Disability Severance Pay and Final Pay always come together?

I'm asking because I received my severance pay a couple weeks ago, but I'm still waiting for my final paycheck (13 days) and 10 days of leave that I sold back. I separated on 28 June, and my first LES after that was in "status det" and "hold pay" indicating they were doing a final audit...

Does Officer Candidate School time count towards severance pay calculation?

Circling back to add that I did receive my severance pay, and that PSD corrected my DD214 to include my OCS time. The start date of my AD time/creditable service towards severance was my first day at OCS, final day was my separation date. 9 years, 1 month. I was not prior-enlisted. I...

Does Officer Candidate School time count towards severance pay calculation?

Ron, thanks for the clarification. My separation orders say 9 years, 1 month, and I pointed that out to the clerk. Waiting on a response. Generally speaking, the service academies are the higher education institutions run by the armed services - Naval Academy, Air Force academy, etc. The FMR...

Does Officer Candidate School time count towards severance pay calculation?

Now I'm confused - I didn't attend a service academy, I went to regular university with no military affiliation. I'm also medically separating, which I don't think is the same as voluntary retirement. What was it you were clarifying? Thanks!

Does Officer Candidate School time count towards severance pay calculation?

The Navy does the same thing, or did in 2011 anyway. I was enlisted just before OCS, attended OCS for ~3 months as an E5, then comissioned at the end of OCS and was an AD Officer from Aug 2011 until now. The only exception I know of is for those who go to ODS (Officer Development School)...

Does Officer Candidate School time count towards severance pay calculation?

The current calculation is definitely based on a flat 8 years, so regardless, something is amiss...I responded with that same section from the FMR, 7a chapter 35. I think they 1) didn't round up, and 2) are applying the cadet/midshipman/ROTC bit. I'll report back when I get a response. OCS=...

Does Officer Candidate School time count towards severance pay calculation?

No I was Active Duty the entire time. I was 100% a civilian until I turned 30 (way after college) and then decided to join. No prior military affiliation at all.

Does Officer Candidate School time count towards severance pay calculation?

I've found a couple threads discussing the particulars of service academy and ROTC time re: severance pay, but those didn't seem to address Officer Candidate School specifically. I went through ~12 weeks of OCS as my entry point in to the Navy in 2011. I had no prior service, did not attend a...

20% is better than 30% or higher.... prove me wrong

My VA liaison responded and said: It is my understanding if your combined evaluation remains the same after the they deduct the percentage for the condition you receive the severance pay for they do not recoup the severance pay. If they do recoup they will use the payment for the condition you...

20% is better than 30% or higher.... prove me wrong

I should know within 60 days or so and will plan to update this thread once my actual numbers are in place for the monthly VA. I'll see if I can get a hold of my VA liaison in the meantime.

20% is better than 30% or higher.... prove me wrong

I am in the same boat, with 18 VA-rated conditions. The one unfitting condition is only 20% and way down the list, but because DoD is separating me based on that one condition and paying me severance for it, I can't also get the full 100% monthly VA compensation because I would be getting paid...

20% is better than 30% or higher.... prove me wrong

Based on my research, I don't think you can "unclaim" whatever condition(s) the VA rated AND DoD found unfitting. Please post if you find out differently. I have another post on the Navy Timeline forum with more details about my case. I had a ton of VA-rated conditions, only one that DoD...

20% is better than 30% or higher.... prove me wrong

Yes, exactly! I spent many hours researching and talking to various people before I made my decision. Also wanted to clarify that my severance is NOT taxed (or should not be, since I have a VA rating) so the amount is actually $115k.

20% is better than 30% or higher.... prove me wrong

I'm in the realm of the OP's scenario. I decided to take the severance and not press for medical retirement. In my specific situation, it made the most sense. O3, Married, no children, 9 years of service. Medically separating No combat deployments 100% P&T VA 20% DoD I will receive a...

Here's my timeline for anyone who's interested. I work at CNIC HQ, Washington Navy Yard. Nov 2018 - Command received message re: unfit for duty and referral to Med Board. The message was predicated on my enrollment as a Wounded Warrior, history of Stage 4 cancer and related medical issues...

Sanity check - accepting severance or request FPEB

Just for closure, I did end up accepting the separation with severance and 100% VA disability (still pending finalization). All sources I've talked to (subject matter experts) have told me the recoupment from my monthly VA disability will be for the amount of my one unfitting condition, which...

Does VA normally take this long?

I realize this was an older thread, but just wanted to add that I was able to get the funding fee waived on a VA refinance by just submitting information that I had a VA claim pending. This was October 2019. Probably water under the bridge for OP, but may be useful to others.
