So I just got findings back and I am 80% Army/100% VA...when I spoke to the Attorney he said I was permanent and total but because of the PTSD (70% rating) I will be re Evaluated 6months after separating. Apparently this can go on for years until they set the %’s so how am I P&T if things might change?

I would ask the attorney to clarify. Your understanding is correct. So perhaps there was a error in communication.

If you are placed on the PDRL (rather than the TDRL) then there will be no additional evaluations by the military (i.e., DoD) for your military retirement.

Cornell Law RE: VA Ratings: Total and Permanent ratings are discussed at 38 CFR § 3.340 - Total and permanent total ratings <---LINK

I agree with chaplaincharlie. Please note that a disability that is NOT considered static will not be considered permanent. In other words, not static = could change.

Sounds like you have a future TDRL exam but not a VA one.
