Already rated 100% and went through MEB C&P exams. Examiner was asking about all my conditions I am not referred for.

Hello everybody. I am finally in my MEB process in the Army National Guard, after already being rated 100% after leaving active duty. I am being referred for PTSD (70%). I did not file any claims for my MEB as my lawyer told me this could cause my rating to be impacted and I’m already 100%. Well, I just had my MEB C&P exams and the examiner for my general exam was asking me about all my conditions and going through the full eval process even though I did not file a claim. I asked my lawyer if I should be concerned and they said I shouldn’t be but that it was weird I got a full exam.

Does anybody else have any experience with this?

I am in the same boat. I just received my VA rating in Dec, and I was notified today that I am being sent up for a MEB. I was searching the forums to see if anyone else was in this position. Hopefully someone can provide insight into this. While I have my rating already, I have 1 more C&P to go for a few deferred conditions. I was hoping that since I'm already rated through DVA that the MEB process would go quicker. I hope that I do not have to go through all the C&Ps again, and I'm worried if this will impact my VA rating at all? Any insight would be greatly appreciated.
 
My medical team and attorneys have all said it is hit or miss. From the cases the attorneys have worked, the VA can use the same ratings if the exam was "relatively" new. I put that in quotations because it is a subjective term and no MEB process is the same. They've seen exams as old as 4 years make it through and some even further. Just probably depends on what the person looking at your file wants to do. Pretty similar to the VA rater. I'm waiting to be contacted by my PEBLO and all my exams are under 2 years. I'm at 90. If I have any word I'll update.
 
Same for me on the rating. I literally just got my rating under 2 weeks ago. After some digging on here the consensus seems to show that the best way to protect your rating is to not sign the VA Form 21-0819. This way the VA will only rate the unfitting condition, and they will only rate it for the purpose of the MEB and not for compensation. I haven't even been contacted by the PEBLO yet, so this will be my first question. Take a look at this thread:

I’m in the same boat but my claim closed last July. I filled out 2 pieces of paper from the Va through my PEBLO and MSC. One was a statement form that said “service member doesn’t wish to file a claim; for MEB purpose only” and another one that says I wanted to use the rating I was just awarded at. I had a less than favorable general exam as well and I was told it should only effect the dod rating.
