Article 15 while waiting for orders?

Long story short for this first part of Bull i am at the end of Medboard Legit awaiting orders and im gone also NEVER been in trouble before until now AT THE END, Told leadership i am getting orders very soon to get out immediately (expedited orders) also that Family is flying out early so we can all be home for the holliday's.

A servicemember from my Company Told me that the commander straight up told him on his way out from being Medboarded that he does not believe in MedBoards and will stop any that he can because they are just bull crap. He then told me this same thing when he Briefed me i was going to be recommended for Art 15 and he will do w/e he can to stop it if he can because "I have not been in the army long enough to deserve it"

I was informed last month that i missed 4 appointments , 2 were double booked and there was no way i could ever make them and 1 was scheduled without my knowledge.

So i was never counciled for any of them until the most recent one that i technically went to and completed but for some reason they scheduled me again 2-3 weeks later and did not tell me (yearly hearing appointment), the commander took it upon himself to check my history and found 3 more missed appointments from 5-6 months ago and told me he is going to recommend me for Article 15 because i have a pattern. I asked why was i never informed of these so i can go get print outs of my appointments to make sure im not missing anything scheduled without my knowledge, I was told kick rocks pretty much.

I was also told by leadership to pretty much disappear after first formation so i dont get in trouble or get hurt. So they used that against me but i have proof they have been having me skip PT in the morning. Im just a joe i HAVE TO do what my NCO's tell me to do as long as its not hurting myself or others (and breaking the law).

Again Ive NEVER been in trouble until they were informed i was found Unfit for duty, Suddenly all this crap is coming out of the blue as im getting out and Conveniently after i was giving them the curtesy of giving them updates on what is going on with my process.

I have evidence backing me for legit every part of this Article 15 and it seems like they are obviously trying to set me up right before the Holidays and knowing i sold most of my stuff and flew my family out of town already.

What do i do in this situation because now more than ever does it feel really targeted ? Besides eat crap im a useless grunt now i need some useful info homies

Update: So Talked to IG they told me what was going on and the evidence i have is insane they are trying to pull this, they were not allowed to give me legal advice but they did advise me from a Senior NCO perspective to Report this immediately to SGM and Commander along with file EO on Commander since there is clearly no accountability for Junior NCO's and the commanders comments are clearly targeted along with NCO admitting im being targeted as well . I just wanna get my orders and leave man
 
Insane the Army operates like this. Sorry to hear. I would talk to legal and follow their advice, in addition I would file an IG complaint, file a congressional complaint, and file an EO complaint, then once all that is filed and case numbers provided, I would check myself into a mental home as a result. Sometimes you have to go the extreme route dealing with those idiots. Don't have time for this type of BS.
 
The good news is your CO can't stop the medboard or the orders and an ART 15 won't stop it either. From my experience, the only way it can be stopped is if you "kill somebody" aka commit a major crime. However, it's BS they are fucking with you so close to the end. My advice is to follow all orders, keep your head low as much as possible, and defend as needed. IG is a good start there; not sure if 1SG is on your side, but speaking to the SGM is also sound advice in voicing your concerns. Have the mentality and verbalize that you're doing all you can to ensure you are following all orders. Document everything you can and keep documenting; maybe start prepping any supporters/witnesses you work with who can support you as needed. If the CO does go forward with an ART 15, I'd push it to a court-martial; since it's such BS and you're almost out with the medboard, it's very likely the case will be dropped. However, you'll get the opportunity to meet with JAG before then to discuss options.

So unfortunently they cant stop the medboard but they can stop your orders from being cut because of a adverse action flag. i would have been getting out next week if this did not happen :(
 
you are probably getting Company Grade Art15 which will not affect your MEB process and pay. I have a buddy when to the same thing when they found out he stop going to broke soldiers pt.

That is pretty much the only thing they legit got me on is skipping broke people PT even tho my first line told me to stay out of site out of mind and when people came asking questions they threw me under the bus and saved themselves and now im here lol

Going through it suck, but my friend finish MEB and ETS out just fine. Hope it will be the same for ya.

I would talk to your BN CSM. Hopefully he'd see how messed up the whole situation is. Most leaders aren't trying to keep medically separating Soldiers longer than they have to. And with this causing extra hardship due to your whole family/living situation; I would think he'd empathize and make that CO get his shit together.
 
Now NCO's are nitpicking my deadmans profile and making me walk for 5 mins with a chair then sitting for 15 mins ALL DAY. My knee hurts bad from doing this and they don't care. At this point IDK what to do with these people.

Absolutely disgusting. Go back to your PCM and tell him/her and they’ll probably alter your profile so they can’t abuse you like that. Write him/her on MHS Genesis if you can’t walk in and see them to get it changed.
 
They still have not sat me down for my second reading, Spoke to TDS lawyer and showed him all the evidence i have and he pretty much nodded his head and said this is total and utter bullcrap what they are doing to me especially when they have real dirtbags to kick out and this is just wasting everyones time, unfortunately they have the power to do this so they can screw people and also can just chose to not finish the case any time soon keeping me in longer just as a F U to me. We have a Staff sergeant who was suppose to retire at 21 years and they extended him for an atricle 15 that he already beat but the commander refuses to unflag him so he can get out and keep pushing off his final reading longer and longer, he beat the case 6 months ago and he has been extended now 3 months. Seems like my company just screws people over.

I’d go walk into the BN CSM office and request to speak to him. Act desperate and plead for his help.
 
So i was going to do that today but they finally did my second reading because i told them i was going to speak to SGM and they pretty much didnt punish me at all since i had evidence defending myself pretty much nullifying anything they were trying to ger me on. They dismissed all charges and only hit me with reduction of rank from SPC to PFC. Still insane they wanted to do that to me but i dont even care anymore i just want to leave at this point i was 100% going to appeal this if they went through with hitting me with the book like the first sergeant wanted to. Crazy how i can present evidence that your NCO's are pieces of shit and still want to fuck me over just because.

So at the end of the day they pretty much just ruined Christmas for my family and i since i flew them out early so i could be home in time and stopped my process over bullshit they didnt think i could prove. Infantry upholds its notorious shitty leadership record.
 
My previous suggestions was based on a similar ordeal with my wife getting out and the route we took to put an end to the nonsense. We made it as far as court martial. So I am well aware of what you are going through. Fast forward years later that same leadership reached out to apologize as life took a turn for the worse for them. But I want to correct you on something. They didn't ruin anything. They tried and failed and are desparate playing their last card. You are still leaving with a lifetime of benefits to take care of you and your family. Their efforts only proves your decision to separate was the correct one. They can take your rank, uniform, boots, and socks at this point. Who cares. Wash it and fold it neatly for them. It all still worked in your favor. As you age and time passes you will look back on this moment and realize you won in the end. Right now there probably is a sour taste in your mouth from everything that has transpired, but even that goes away after a meal and some toothpaste. Just give it time and look forward to your new life. Take a 3 day cruise to really reset your mind quickly. Pretty cheap rates right now. Keep your head up and try your best to leave quietly.

Most importantly Be proud of your accomplishments, and be grateful and appreciative you had the privilege to serve regardless.
