Camp Lejeune timeline

Jeff simply told me that at this point the VA is giving me a proposed rating, and the process is held up with them at the moment. No fitness determination has been made yet. I understand that the VA creates a proposal regardless of the board's fitness determination, but it just seems strange that the case is seemingly up with them but no fitness determination was made.

Jeff did say he would likely get something in the next few days, but to call back in 3 weeks time.
What time do you call Jeff he never answers when I call

I just talked to Jeff and he told me my stuff came back from the VA and it should be a week

Small updates for today: Called paralegal, scheduled an appointment for the 22nd at 9 to ask about that VTA tracker. Called Jeff, he told me it's still at the VA and they haven't returned proposals yet.

Now the interesting notice is this: the 1000 number told me that my case is pending decision approval. A decision has been made on my claim, now it's just pending release after approval.

I called the 1000 number too and they told me they sent my findings to the PEB on the 15th

My PEBLO refuses to give updates until my findings are in and my MSC can't access VTA for a fitness determination. Really hoping my lawyer has access or I'm up shit creek.

I've read usually once it populated you should be getting your findings is a weekish but who knows

Final update I have for today: I called again just to confirm (this stuff seems to be misinterpreted an annoyingly large amount of times), someone else told me that I'm NOT in the approval stage, and then the final time I called I was told I will most likely receive a finalized decision in 2 weeks (presuming this would translate to the PEB receiving findings).

I won't have anything else until Wednesday. Again fingers crossed my lawyer has VTA access.

I honestly think some of the reps at the 800 number just tell you what they think you want to hear because it’s so consistently inconsistent.

I’m going to try and hold off calling anyone until the end of the week or early next week. I’m about a weekish behind both of you.

Things just weren't sounding right, had some time before work and I called about 5 minutes ago.

Got kind of lucky and got a guy in the phone who was familiar with how to read these cases. My proposals were forwarded to the PEB on May 17th. They are awaiting a response from the PEB, apparently. This confuses me a little bit because Jeff is saying that my case is still with the VA as of yesterday. The guy I spoke to at the VA said under no circumstances am I meant to see the proposals.

I called one more time, since the confusion between agents seemed to run high. The lady I spoke to immediately offered to email me the proposal documents... I said sure. She told me that it should arrive by the end of today in an encrypted, no reply email to my email address. I got the documents in my email about 5 minutes later.

Proposals are what I expected. 100% VA and 40% for the condition I was boarded for. One claim was deferred.

This is not guaranteed of course. These are proposals from the VA to the board, and I'm obviously not meant to be seeing this. But the introductory paragraph provides some ease to my mind. It's as follows:

This is a disability determination under the Integrated Disability Evaluation System (IDES) Program, a joint initiative between the Department of Defense (DoD) and the Department of Veterans Affairs (DVA) in the case of [REDACTED PII], currently a Member of the Marine Corps, who has been referred to a Physical Evaluation Board (PEB) as unfit for continued military service. This disability determination is being prepared to assign evaluations to the service member's unfit conditions for use by DoD in determining a final disposition for unfit conditions as well as to determine the member's potential entitlement to DVA disability compensation.
The determination of entitlement to DVA benefits is contingent upon the Member's discharge
from active duty and upon the Member having the requisite character of discharge, as specified in the regulations. In the event that the Member is not separated from service as a result of the IDES process or, upon discharge, lacks the requisite character of discharge, this rating is null and
void for purposes of entitlement to DVA benefit. For purposes of determining potential entitlement to DVA disability compensation, service connection may be established for a disease or disability that began in military service or was
caused by some event or experience in service. Your enlistment examination was not available for review at the time this VA Proposed Rating
was written. We will attempt to locate it prior to the VA Final Rating and the evaluations proposed herein are subject to revision based on the contents of the enlistment examination.

Based on a review of the evidence listed below, we have made the following proposed decision(s) on your claim.

(571) 442-0592 is the number for the PEB rep. Jeff is the PEB rep. Also probably the only guy with somewhat up to date information in the process. I love wounded warrior, but they couldn't get me any up to date info. I might give them another call just out of curiosity tomorrow though.

The one thing I don't understand about this process is we are assigned peblos to assist us during this and once your package goes to PEB they will literally ignore you until they get your findings back. I mean I have sent 1 email to request an update (due to peblo requesting emails over phone calls) since my package was sent up over a month ago and it's been 5 days no response what so ever. It seems everyone that is involved keeping us informed are to lazy to send an update once a month or every 2 weeks.

Did your lawyer end up having VTA access?
