In April 2023 I petitioned to the Board for Correction of Naval Records (BCNR) to correct my service record. I entered the Navy in July 1974 and was honorably discharged, at the rank of E-7, 4 months short of retirement. There was no Admin Board or any record of convening of an Admin Board for me, nor was I granted any opportunity to receive medical/psychological evaluation (which is not an option or is required). I was discharged because I admitted to being Bi-sexual though on my DD-214 it says "homosexual admission." On June 7, 2023 I received a letter from BCNR stating that I had been unjustly discharged, and had it not been for DADT I would have retired on July 31, 1994. Also in that letter BCNR also ordered that I be issued a new DD-214 which will indicate a release from active duty on July 31, 1994 which will bring my retirement to 20 years and one month with a characterization of service of "honorable" narrative reason for separation of "sufficient service for retirement," SPD code of "NBD," reentry code of RE-2, and separation authority of MILPERSMAN 3855180. I received no retirement pay from July 31, 1994 to the present, therefore, it can be said that I might receive a substantial amount of retroactive or back pay. Does anyone have any idea how Defense Authorization and Accounting Service (DFAS) computes such a scenario as mine? I tried but I might have left out some things. I wonder will they take into account pay raises, taxes on the retirement pay, etc. If anyone can help would appreciate it.

The computation would include COLA increases, tax withholding, etc.

The Defense Finance and Accounting Service (DFAS) will need supporting documentation from the Navy before they do anything.
At this point, I doubt they know about your case, just an opinion.

I suspect in addition to the DD 214 or DD 215, the Navy will have to prepare a retirement packet for you and send it to DFAS.

It seems the ball is in their court.

Hi Ron; thanks much for replying and thanks for your answer(s). In fact, DFAS has already reached out to me; so, Navy must have already forwarded them supporting documentation. For some strange reason, DFAS asked me for LES's for the period 3-3-1994 to 7-31-1994; however, I replied to them to let them know I was not on active duty after 3-3-1994 and have never received active duty pay after that date; it seems its just a waiting game right now. Back in June, late June, I was told it would take 90 to 120 days. So it appears that everything is being put together, and yes, the ball right now is in DFAS's court relative to accounting, computation, COLA, tax withholding, etc. Thanks again Ron.

Thank you. I never worked for DFAS. It would have been my 2nd choice in 1991. I retired from the Army Finance Corps and chose to work at a university instead. Less money, but found a great place to raise my 12 year old son.

Wow I'm sorry that you were discharged this way and it was a great injustice that I'm sure made your life far more difficult than it should have been for years. That said, you're about to get a very fat paycheck.

Wow, how fat I don't know, but 29 years is a long, long time, and pay increases (COLA) to go along with it. I read somewhere that Uncle Sam will hit me with a 28% tax? Is that true? That sure is a lot, but I won't complain. I'm very very thankful. I was tops as a First Class and Chief, and then when they messed with us with that DADT hush hush thing, which messed most of our heads up (fear of witch hunts), they threw me out like a bag of garbage at the landfill. I kept having these dreams of me being in the Navy and not having retired all this time (PTSD I think); in the dreams they kept me working and on active duty, and working, and I had submitted my retirement papers but they kept me on active duty. The last dream I had was in early April of 2023 and that dream was so real and so vivid that I knew that I had been done wrong, and that someone owed me (the Government/Navy). I submitted my petition to BCNR on April 7, 2023. That aside, glad it's almost over. I am an old man now, will be 67 in October, and it's been a long ride. I thank all of you for the encouragement, apology on my behalf, and the education to boot. I hope you all, if you've been done that way, will receive the same and more. Cheers and God's blessings.
