I've been on the MEB since July 2021, PEB accepted November 26 but I also failed 1 term of BCP and am pending admin sep for minor misconduct, does anyone know how the dual process works
 
I wish I knew also. Grandson supposed to administration seperation. All paperwork is in 2 weeks. CO told him to go that way. He has been injured for more than 6 months. Doctors said they would not med board him . First they were then changed mind and now he just wants out.I don’t know where you get free legal council in San Diego. He tried 3 times to get help from jag, but was told unless he is med board they aren’t available. Good luck to you
 
From my understanding MEB will always trump any concurrent proceedings as long as it does not involve misconduct.
 
There has been no misconduct whatsoever. He is so frustrated. TBI, lost his hearing and wears hearing aids now. Nerve damage to neck and back. I had to pay for private mri which they would not look at told him disc could be bomb!! PTSD big time He gets 37 shots a month of Botox in his head . That’s some of the things. He was injured during buds training. Which was a something he had prepared for and was ashamed of himself for getting hurt. Some background D1 lacrosse graduated umass Amherst and nothing was going to stop him from going in the Navy for life and protect his country. His great grandfather was frogman , his grandfather Army and father Marine.

Body composition? If that is what is is the MEDBOARD will take precedence. If you did drugs or something else that would require admin sep. They would close your med board and follow through with the admin sep.

That is wrong. They will not “close out” MEB. Enlisted goes to the general court martial convening authority. Officers go to a board at ARBA for the army. If there is a nexus between the misconduct and the underlying medical condition chances are good for medical retirement. The severity of the misconduct and the underlying condition way heavily.
 
It’s more of an uphill battle, but not impossible. It really depends on how bad the misconduct is versus how serious the injuries/illness are. Also, the entire service record is taken into account. Without more details I can’t predict an outcome.
 
I went through the dual process myself. I did have connection, or "nexus", between misconduct and medical disability so it went medboard for me in the end. At first the general had picked adsep but luckily I had good copies of my records and was able to provide documentation of the link and he re-ruled in favor of medboard. This was also using my provided jag attorney as a representation to the legal team in my command. So put them to use if you can.

But yes, as mentioned above, the two packets for adsep and medboard will be presented to the first court martial convening authority within your command by his legal team for a decision. From what I've seen on here in the past, very minor misconduct, failed PT tests/height weight stuff usually isn't the route the go. More major misconduct is a bit more if a battle yea.

plantar fasciitis fibromatosis, and the njp was company and it was dumb they said I failed to complete my trs assignments within the week of trs, and I lost my motor t licenses
 
I’d say you’re it’s literally a coin flip. You’re at the whim of the general. Is there more to the story? Sounds like really minor stuff to be getting an admin Sep for.

I was a commander. I hear this a lot from soldiers. I highly doubt your chain of command would risk their careers to unjustly punish you, because you don’t “kiss ass.” Get what you’re entitled to, but look in the mirror at how your actions have affected you. I had to do the same. You’ll be better for it in the long run.

Meaning I reported unjust behavior I've witnessed that they've tried to cover up, there's more to the story then you think

There is shady things that go on within the military you should know very well being in the army
