I wish I knew also. Grandson supposed to administration seperation. All paperwork is in 2 weeks. CO told him to go that way. He has been injured for more than 6 months. Doctors said they would not med board him . First they were then changed mind and now he just wants out.I don’t know where you get free legal council in San Diego. He tried 3 times to get help from jag, but was told unless he is med board they aren’t available. Good luck to you
Try your local congressman, they handle military matter as well
 
I've been on the MEB since July 2021, PEB accepted November 26 but I also failed 1 term of BCP and am pending admin sep for minor misconduct, does anyone know how the dual process works
I've reached 7mos on the medboard and 3 mos with the PEB but does it really matter, medboards are taking too long for me to hope for it to come back before an admin sep does
 
I’d say you’re it’s literally a coin flip. You’re at the whim of the general. Is there more to the story? Sounds like really minor stuff to be getting an admin Sep for.

I went through the dual process myself. I did have connection, or "nexus", between misconduct and medical disability so it went medboard for me in the end. At first the general had picked adsep but luckily I had good copies of my records and was able to provide documentation of the link and he re-ruled in favor of medboard. This was also using my provided jag attorney as a representation to the legal team in my command. So put them to use if you can.

But yes, as mentioned above, the two packets for adsep and medboard will be presented to the first court martial convening authority within your command by his legal team for a decision. From what I've seen on here in the past, very minor misconduct, failed PT tests/height weight stuff usually isn't the route the go. More major misconduct is a bit more if a battle yea.
I’m curious if you don’t mind sharing, how long did it take after admin sep packet got sent up to CG for determination between separation and medboard, to get your answer? Also, once he ruled separation first at what point did you get a chance to submit documentation to have him change his mind? I’m currently in this situation 14-12c. Alleged Misconduct is related to combat ptsd, TBI as stated in medical documentation that I already provided. Even provided them at my admin sep board and they still recommended OTH discharge. Long story short I was falsely accused of domestic violence, civilian charges dismissed and my wife who was in my company admitted to lying and making a false official report. I’m at the hands of the general right now and I’ve been stressing. I was set to medically retire but obviously MEB cannot continue unless he gives the ok.
