I'm not sure if I am posting this in the right location. I am looking for help regarding my husband. Here is a little history recap on what we are dealing with. He was AD USAF from 07/2003 to 01/2007 with a deployment to the Middle East 09/2004 to 01/2005. He had several injuries during his AD service including back injury, shoulder injuries, and knee injuries to name a few. These are the major ones. He was never treated properly for any of these injuries. He was always just told they were muscle strains. No imaging was performed on his back and the VA never performed any either. His knee injury occurred in late 2005 which caused him to be placed on many profiles. Due to the injuries, he began to gain a lot of weight because he was unable to move to exercise. Going to work was painful. (He was POL). While on these profiles he was PT tested (even though he shouldn't have been) and failed several times. He was recommended for early discharge for "Failure to Meet Physical Standards". They gave him no information on the discharge process other to say there was no point appealing it. He was discharged in January of 2007 and was awarded his first VA Disability rating (30%) in October 2007 with the dates of his injuries while AD being the effective dates. Between 2007 and 2019 he constantly had to change jobs to something easier and easier due to the pain. In June 2020 while driving his semi he was hit by a minivan which basically did his back in the rest of the way. Someone finally did some imaging and low and behold his back has been all kinds of messed up since he hurt it in 2004. The doctors say these are injuries that have been there quite awhile as they are not something that can come on quick. So we applied for an increase in his VA Disability and finally in November 2021 they awarded him 100% T&P.
Now my question is this. If this back problem started while AD and PT tested while on profile, shouldn't he have been medically retired and, if so, how would we get this changed so he can receive medical retirement pay from the military? He wanted to finish his contract. They gave him no choice and he is now 100% T&P. If his injuries had been treated properly when they first occurred I don't think he would be in as bad of shape as he is now. It just feels like he got really screwed over, which I know, is the military's way of doing things. Any help/advice would be greatly appreciated.
