Help... CRSC and IU determination, just finished PEB

Hello! I began this journey with MEB/PEB last September and my wife and I are finally seeing the end of the tunnel!!

1. High three base pay average $7,000

2. DoD disability retirement percentage 60% Army

3. Years and months of active duty computation. 15 years, 3 Months or 15.3

4. VA compensation: 100% P&T, with a spouse, no kids; $3336 ($3227.58 + SMC-K1)

5. Expected 60% CRSC- (PTSD + Tinnitus)

Questions:
- Under current law, does 60% CRSC equate to IU, thus getting the 100% CRSC award?
- I have 50% PTSD and 40% TBI, which the PTSD was taken at a higher percentage; (examiner couldn't separate conditions during exam) would these combined conditions = IU for CRSC purposes?

6. No, only CHP 61 retirement. Total time, less than 19.

Thank you for the assistance and having this Forum to help out Veteran SM's transitioning.

Hello,

Excellent response to questions...RonG

Case.

Estimate.

A. 7000 x 0.60 = 4200 retired pay
B. 15 years 3 mo = 15.25 yrs 15.25 x 0.025 = 38.13 longevity multiplier
C. 7000 x 0.3813 = 2669.10 longevity portion of retirement
D. 4200 retired pay minus 3336 VA comp = 864 residual retired pay
E. Individual Unemployability (IU) is not a disability or a diagnosis therefore the service branches do not include it in the total combat-related disability percentage or address IU on decision letters. Eligibility for IU is determined by the Department of Veterans Affairs (VA). Defense Finance and Accounting Service (DFAS) will include compensation for IU as they receive notification from the VA of a retired Soldier meeting this status.
Please note, IU is only added to a retired Soldier's Combat Related Special Compensation (CRSC) benefits by DFAS when his or her CRSC total disability percentage is 60% or higher.
F. longeivity 2669.10 - 864 residual = 1805.10

G. The maximum possible CRSC is your case is 1805.10 + 864 residual retired pay = 2669.10 Total paid by DFAS each month unless...
the CRSC approval by your service (and DFAS adding IU amt if applicable) is LESS than the longevity portion of retirement, then..that amount will be paid, but when coupled with residual retired pay cannot exceed the longevity portion of retired pay

Bottom line: I suspect the monthly amount paid by DFAS will be: CRSC @ 1805.10 + 864 residual retired pay = 2669.10 Total paid by DFAS each month

Got an update from HRC Today; figured I would share:

- Final Retirement Date: 30 SEP 2019
- HRC Received My CRSC Packet: 11 DEC 19
- Decision Made: 19 DEC 2019
- Total Combat-Related Disability: 90%, Effective 1 OCT 2019

BL- I sent them everything in the order of requested HRC application in an overnight delivery envelope. I was rather impressed with an 8 day turn-around decision!
We shall see how long it all shakes out with DFAS to get the back-payment, etc.

@RonG thanks again!

That is one of the fastest approvals I have seen.

Congrats...
Ron
