Jason, you should see my issues with this. Mine is a rollover from combat ops. I was simply put "NPQ" on recall and discharged. I had no idea the regulations or what I should have been entitled to.

CA leads out of all states. But this is an issue across the nation. In AZ my unit took two years to complete my LODs. I had no idea of the timelines for formal and informal to be completed in until a new UA came to our unit and began assisting me. She then told me this was long over due. I came from active duty into the reserves, not sure if that changes anything with the LOD process, but at least 4 other individuals in my unit were all waiting over a year for their LODs to be completed as well.

At one point I was coming up on my ETS and was told I could not reenlist because of my injuries. Thankfully our new UA helped me with getting a 12 month extension which from what I understand is a one time deal service members can use while deciding what is next for their future. During this time my LODs were completed and fortunately approved which ultimately initiated a MEB proceeding. During that time, a 12 month medical extension was initiated to completed the MEB which resulted in a favorable outcome and put on the permanent retirement list. I believe if the UA that helped me had not shown up when she did, my ETS would have approached with my unit telling me I am not eligible to stay in and being forced out with my LODs going uncompleted.

Hope all is working out for you GUNS'N'Stuff. This is not the way things should be handled.

I see that I am not an exception to this happening to ACDU to reserves, no LOD. I want a FPEB in my case because I am going to go explain to the board in person what happened in good details so they understand me and what happened. I see you had a IPEB. My command didn't treat me in combat and I waited 6 months afterwards and that is with me being shot, in an IED, and other stuff. God, I should be dead in all honesty. This was back early 02' when things were different.

Really appreciate you getting back to me and would like for you to help me if possible. I will likely find myself in similar boots soon and will apply for CRSC, etc. and since you have been through this already any advice you can provide would be a milestone. So, can I kindly PM you?

Sorry for the troubles you are having. Please feel free to PM anytime. I try to check things at least once a day. Anyway I can help and share advice I will. It is all a painful and lengthy process. I think that is the hardest part, waiting for updates, receiving communication, wondering if everything is done our your end correctly, etc.

I look forward to helping out anyway I can!

Hello,

I am going through an incomplete LOD process as well but in the USAR in California. Does anyone in the reserve have a similar experience?

The Board so far has completely ignored the LOD records to include all supporting evidence, laws, rules and regulations in their decisions, I do not understand how they can get away with it and it as if there is no oversight and I don't think their is any recourse except Federal court. I am really being screwed here.

I have all the documentation showing the "NPQ" referral and discharge, the BCNR completely ignores this information about MRR LOD for "PEB" disability proceedings, how is this allowed to happen, its a clear violation under CFR.
