Yesterday i received my VA rating/PEB informal 199 the VA indicated that my Hand injury was not service connected because there was no LOD or investigation for this injury. I injured my hand performing extreme PT during BA in May 22nd 2021 but not severe enough to go see a medic but a soldier knows that i hurt my hand. Several weeks later the pain got worse so i contacted my VA primary Dr he told me to go to and Urgent care facility that can take X-RAYS so i did they gave my a splint and the X-RAYS did not show any fractures. My doctor referred me to the Hand surgery Clinic in Miami. They were able to see in June the X-RAYS showed no fractures but they gave me a cast gave me a follow up for one month Then they found out that my left Ulna was compressing my Nerves and Tendons, the nerves in my wrist and elbow were compressed. That i needed surgery i notified my Unit the gave me the documents for the LOD i completed my part as well as my Doctor they submitted it but it was returned because the digital form they created did not match mines they were given instruction on what needed to be corrected but they never did it it was not return when i questioned them they were working on it it has been more then 120 days i need this so the VA can see it happened on Duty. The Army said my Hand Injury met Standards. the fingers, Elbow in my left hand are still numb and i have Hyper Sensitivity in my palm, I have a Temp profile for this injury. I'm currently getting physical therapy As for my 7809 the doctor said i cannot perform the ACFT or lift anything heavy that i cannot even hold a weapon can this be found UNFIT for the Military. If they cannot find me UNFIT and just get my Disability Severance pay for my Type II Diabetes. Can i Sue them once i'm out.

Nope. You are in a bad situation. If you are in the Reserves or National Guard and get hurt you have to go to the hospital to get it checked out the SAME day of the injury and have a LOD done. If you don't have any unfitting conditions that have a LOD they will kick you out without severance or a medical retirement.
