MEB and Promotion/High-3 Retirement

My primary care manager is recommending MEB for a back, knee and shoulder issue. I recently tacked on E-8 and if subjected to a medical discharge will I receive full E-8 retirement pay despite not holding that rank for 3 full years under the High-3 retirement?

Yes, you will retire at your present grade. The pay calculation is based on the average of your high 36 months of actually received basic pay.

Thanks. Do you know if that is waiverable? I've only been an E-8 for 3 months, yet the AF is saying I need to face an MEB.

There is nothing to "waive." The calculation is based on the disability retired base pay (which is the average of the highest amount paid over 36 months).

The amount is based on what you actually have received. No raise, a huge raise, a triple raise, a pay cut....its all the same. The retired base pay amount is the average of the highest 36 months of actually received pay.

I say that you guys are killing me because this has been the law for about 70 years. I have written about this about 100 times. I have stated it again and again. Don't know how to communicate the rules and the calculations better. Previously, I have (dozens, probably many dozens of times) provided references (both to statutes and to implementing regulations) showing this is the case and there has never been an instance where this calculation has not been applied.

Can't do more than that, I think. I don't know what other answer I should give. I am completely confused about how to say it another way or what I should have written to have said it better. Am I missing something?

I am sorry if I come across as upset. It is just maddening when I have addressed an issue many dozens of times, have said the rules, get asked the same question, answer it and then get further questions that basically have an underlying assumption or follow up challenging the premise or answer that I have already given. Tends to drive a person over the edge.

Sorry I am new to this and couldn't find the answer just do me a favor if your upset that I asked a question and it pissed you off that much just don't answer it.

You mean, answer it again. Having answered the question probably hundreds of times out of the more than 11,000 posts I have made here.

Seriously considering closing the forums permanently for further posts and just posting myself on ongoing issues.

Will think this over.

But that is what makes this forum great being able to communicate with others and helping with the anxiety of waiting around.

I am going to close the forums for a period of time.

Most likely course of action will be opening for review of old posts and just re-opening as more of a blog where I post and have folks have the ability to respond.

I appreciate that and I think it is a great part of the idea behind the forum. However, having spent a couple of hours last night and today (answering posts and dealing with back end forum issues) along with my actual work (and then dealing with personal family stuff), I am thinking maybe the time is right for a pause.

Will think all of this over. Soon.

The point of the above was that in about 30 seconds, using the search function, I found these posts/threads/forums.

I am not pissed when people ask questions. I am very frustrated (at the moment) that people either don't search for answers OR accept when I do answer and still question that answer.

I may have failed everyone here. Maybe I have not set up the board/forums well enough to facilitate finding answers that have been given before. (Though, that has nothing to do with folks not accepting my answers).

Need to think on this a lot more. Work on the board overall is ramping up and ease of use or my goals being met seems to be going down.

Will chew on this a lot more and figure out the best way ahead.

I understand your feelings Jason. It can get frustrating answering the same question, over an over. I'm willing to brainstorm potential solutions with you.

Jason, take it easy. It was only a question. I've just found this website for the first time and understand the 36 month rule. If answering the post is "killing you" then just don't answer. On the other hand, I assume your response to others was not as drama filled as the response you gave me. Hopefully your previous responses on the website helped others...your response here was just unnecessary.

So, I did need some time to think about things. Still, haven't resolved all of my thoughts or the way ahead. But, for now, I opened the site back up. I may make changes about who can post, perhaps require folks to read an introductory thread before posting. Again, need to think about things and need the time to implement any changes.

First, the tenor and the contents of the responses in this thread made me HOT. First time in the nine years this board has been up that folks came here and thought it made sense to tell me to do them a favor and not answer or to "take it easy" or that my answer was "drama filled." First time also, that I have felt a real impulse to wrap up the whole site, call it a good run and spend my time elsewhere.

Second, while I am still salty about the tenor and the response, I did take the time and the main reason I am not taking extreme measures right now is that I know that there are lots of folks that we do help.

Here is what I am not okay with. Do not come here and be discourteous. Don't like what you get here, the answer is to leave (voluntarily or otherwise). The answers to most questions have been already answered many times over. So, using the search function is your friend. That aside, I am floored by the discourtesy shown me...even and especially when I still answered the questions but, the posters did not bother to search for the answers and when I gave them the answers, they did not accept them. Not only were the responses discourteous, there was a baseline discourtesy of not respecting the answers that were given in an effort to help. This made me doubt what I am doing with my time here. Still, gnawing in the back of my head is the young servicemember or spouse who does not know at all what is going on, needs help and can benefit from the forums. That is probably 90% of why I opened the forums back up so soon.

I will endeavor to help folks where I can. That is the main goal- to help folks. That is the only reason I spend my time keeping the site going and answering questions.

(BTW, no need for folks to offer further words of support. The best support is helping others and successfully navigating your case process. I do appreciate it when folks share kind words- and better, when they have gotten favorable results as a result of this community.)
