MEDBOARD vs Chapter

I got myself into some trouble and now facing admin sep for misconduct. All this began last year it’s been around 14 months now. I submitted a resignation in lieu of elimination which is still with the CG. My company and Battalion commander approved but brigade commander denied my Resignation.

Recently I reached MRDP and was referred to MEDBOARD. What happens from here? I’ve heard and read so many things. Many people told me my MEB will trump that chapter. I’ve already read of people getting chaptered instead MEB. I’ve seen it’s a dual process and both go to CG to decide.

I just want to prepare mentally. I’m afraid to get too happy this MEB if finally happening. Our old CG was recommending me for OTH with everyone disagreeing with that to include my BDE CDR (whom I believe hates me with a passion) I’m afraid of not being able to continue care and not receive any benefits. Which ive deployed to Afghan lost friends and been in numerous fire fights. All that to just disappear. I took accountability for my mistake….Thanks everyone in advance. I forgot to add I have about 7 years total AD. 3 enlisted 4 officer. I had a break in service in between to go to school.
 
You'll be in my situation, a dual-action. Your admin separation and MEB will progress parallel to each other. Once both are completed, your total package (your admin sep + MEB) will be submitted to SAFPC where they will make a decision. However, because you do not have 16 years of service, SAFPC will forward your package to your General Court Martial Convening Authority (GCMCA) who will render final decision. There was some confusion on this last step, but I got some clarification directly from SAFPC themselves in an email. It's regarding my case, but the information still applies to you:

"Your case was returned to AFPC/DPFDD back on 5 Jun 2024 because you have less than 16 years of service. SAFPC only boards dual action cases on behalf of SecAF for officers or enlisted members with over 16 years of service IAW DAFI 36-3212. Your General Court Martial Convening Authority (GCMCA) will render final decision on your case. Recommend you contact your ADC, PEBLO, and/or base SJA on the status." ([email protected])

Sit down and get comfortable, because dual-action cases take a long, long, long time. For example, I'm going on 2+ years in this process and the last ~5 months of that has been exclusively dealing with my GCMCA/SAFPC. Just keep in constant contact with your team: the First Shirt, PEBLO, CC, providers etc. as they all will be tracking your case as it moves through every bureaucratic channel.

Wow 2+ years?!? I was not expecting that at all. We had a guy simliar situation and he was gone within a year and got his MEDBOARD over chapter. Do you know what deciding factors are or anything along those lines.

I've seen people on here with pretty quick cases, but I've never seen a dual-action case be quick. In terms of what the deciding factors are, I would ask your First Shirt, CC, or PEBLO as they would have more accurate answers than anything I could provide.

I'd recommend looking at DAFI 36-3212 para 1.6 for clarity regarding the dual action process.

Ok thanks! I was just told by PEBLO that the CG makes the final decision not sure of how true or untrue that is. I'm not sure if you are an officer or not but I put in for a resignation and waiting for the CG to approve or dissapprove. Not sure if that makes a difference or not.
