NAVY w/19yos MEB for asthma

I was diagnosed with severe persistent asthma due to a newly developed unavoidable allergy, and referred to a MEB/PEB (developed during deployment). I just reached 19yos this month and I want to stay in. I am on dupixent along with daily steroids. Meds are stopping severe reactions, but I still use my rescue inhaler daily, and a course of prednisone at least once every couple months. Doc has told me that NARSUM will recommend Retention along with the NMA. Anyone with experience for those who want to stay in? Or what I should expect?

Additional info, I did 6 months of limdu and was cleared. I am told the reason for MEDBOARD is due to the dupixent not allowing for sea duty.

I would fight to stay in but make sure to delay, delay, delay so you hit 20 years regardless of the outcome. A good tip that helped my wife delay was that she request to only be seen by female doctors for all of her C&P exams. Then after a few months of delay she dropped those claims and it moved forward with IDES but now she will hit 20 years:) Also, let your PEBLO know. They can be slow for you if that is your goal!

I would not have thought of asking for female only doctors, thank you.

After my brief chat with the PEBLO, it didn't seem that she knew the instructions very well, or that she is just used to people asking to get out. I am very worried that I may not make it to 20.

You should be worried. You are cutting it close! Save all of your leave. Unlike ETS'ing or regular retirement they have to let you use all of your leave towards terminal leave for medical retirements. Hitting 20 years even if found unfit will increase your compensation because then you would be eligible for CRDP. That is getting both your pension and VA disability compensation at the same time! On top of delaying appeal everything! Lastly, I know of some great private attorneys that i will PM to you. They aren't cheap but I would have one hold my hand if I were you with so much on the line. There have been people discharged with just under 20 years with only severance. Also that severance is recouped by VA disability. Don't be that person! Be proactive!

Can’t a retirement packet be submitted now that TIS is over 19 years?

Normally yes. However, you can't submit a retirement packet when in IDES. So if not officially in then yes submit retirement packet and hope they leave you alone:)

I recommend you talk to your pulmonologist. He/she may be able to swap you not fitting medication for something that is not on the list of medication that provoke an MEB. If the pulmonologist can do that for 6 months, you can then change back and make it 20! Lots of $$$$$$ is at stake.

Many threads here on how to delay. At least 6 levels of appeal you can appeal based on anything nitpicking.

1. Narsum rebuttal
2. Request IMR
3. MEB rebuttal
4. PEB nonconcur/appeal
5. IPEB/fpeb (one or the other, not both)
6. VARR
7. Disability agency review

That’s seven times you can take all ten days just to sign documents then rebut or nonconcur and appeal to the next level.

Also save all terminal leave it counts towards 20.

Is it 10 days for the Navy? The Army reduced the time to 6 days.

It used to be ten for all branches then the army dropped it but I haven’t heard of any other branches dropping it.

We should find out:) That way we know for sure and can advise accordingly.

Unfortunately I have tried many other medications, but this is the one that is finally helping me. If I get off of Dupixent, it would be very difficult to be approved to restart it. Also, it is very expensive and not one easily afforded out of pocket.

I have been doing some reading in the SECNAV M1850.1 ... I may be able to apply for Permanent Limited Duty (PLD) if I am found unfit as well...that can buy an additional 12 months

Another delay tactic that @Provis recommended to someone else is to ask for all female C&P examiners. It might stretch out you C&P exams for a little bit.
