1. I’ve been P&T with the VA for years.

2. I’m currently electing concurrent pay vice CRSC. Based on the PACT Act, I could ask the VA to rate a presumptive condition that would raise my CRSC percentage to 100%. In which case I would elect CRSC for tax purposes.

Here is the catch, the VA rating on the new condition is a temporary rating. Will having a new temporary rating disestablish my P&T? P&T is only important to me because of dental benefits.

If a Veteran is 100 percent P&T and awarded a new temporary disability, he or she will remain permanent and total. A new disability has no bearing on your permanent and total status.

Non-permanent 100 percent Veterans are eligible for free dental.

Thank you.

Chaplain Charlie:
Due to the PACT Act, other presumptive disabilities, and surgeries, I've spoken with Veterans who were eligible for SMC-S Housebound (a single 100 percent disability plus a combined 60) and a change from CRDP to CRSC. Many Veterans failed to file a claim, due to surgeries and sickness, within the statute of limitations to receive temporary 100 percent or SMC-S. As you are aware, housebound is about 445 dollars over the 100 percent rate so it could last months to years depending on the Veteran's situation.

Here are a few references for dental eligibility to include total disability. Veterans in the VR&E program with a VA rating less than 100 percent can qualify under 38 CFR 17.161(i) category class V. The VR&E is great program and opportunity for exiting service members with less than a 100 percent rating to take advantage of the dental program.
