Question Regarding Permanent Profile — Conditions Listed

Hello all,

I’m so frustrated because I previously found something that was somewhat regarding my question on this board and now I cannot find it.

I recently received a permanent profile.

It indicates a P3 for depression and P3 for my trachea.

My interactions thus far w/ the IDES office and my PEBLO have been less than stellar. The PEBLO is incompetent. She’s unable to effectively communicate or answer direct questions. Further, she’s given me incorrect information multiple times and I just started this process. The IDES physician is apathetic and I have been told for 6 weeks I would receive a call to discuss my concerns.

ANYWAY, this morning I received the signed permanent profile. It does NOT include my bladder issues. I have had significant procedures and taking medication long term for my bladder including completing stage 1 of an interstim device.The only reason I did not have the device put into place was because of future pregnancy. I tell you all this to state, I am not a doctor, but I can read the regulation - there is NO way my bladder conditions (there’s actually two from the regulation) that meet retention requirements. They don’t put in a spinal stimulator over nothing.

When the PEBLO called me this morning I asked her WHY it was not included. She told me I can claim it w/ the VA. That does not set right w/ me. Or how about someone at this office does her job and see if what I am saying has any validity. It’s not like she’s coming back and saying it does in fact meet retention standards. She’s just giving me her normal half a$% answer and expects me to go on my way.

I am concerned because once I am finished having children, I am very likely going to want that device because I have exhausted all other conservative treatments.

And shouldn’t the permanent profile Include all conditions that do not meet retention standards? I found that somewhere in the regulation previously but now I can’t find it and certainly this IDES office (should be the experts) are ZERO help!

How important is it that I press to have this added? Another concern is I was told this same IDES physician drafts the NARSUM. Why should I trust that she would accurately reflect it in the NARSUM if she can elect not to include it on the profile.

My PCM is currently on leave, so unfortunately, I can’t contact him.

So this is super important. All is not lost though. The bladder condition can be added as unfitting. If they won't add it at beginning then you are going to want to make sure you get a lot of medical evidence that it doesn't meet retention standards. You will want to fight for it throughout the process by including that it should be included as an unfitting condition well before you get to the end. That means non concurring on basically anything so that you can submit a rebuttal stating that condition is more severe and should be added as unfitting. However, the only time to get it added is at the end through a FPEB. So you need to get all of your ducks in a row so when you get to that point you have a lot of evidence for your appeal and you can show to the FPEB that you have been consistently fighting to have it added as unfitting throughout the process.

Also, consider hiring a private attorney. That is what my wife did. There are only a few dedicated ones for IDES but they know the process well and can help you with your strategy throughout the process to achieve the outcome you desire. A nice biproduct of this is that it makes the process much less stressful knowing you have an attorney that is dedicated to you that can help you and answer questions that you have. The IDES attorney appointed to you through the military has hundreds of other cases. A lot of times they will tell you to go the route that is easiest for them and not necessarily what is the best for you.
 
I’m sorry but can you explain to me why it’s important? I’m trying to get it thru my commander’s head that it is important and since it was only signed yesterday. He basically said I can address it with the NARSUM. that’s unacceptable. The same physician who does the narsum here is the meb physician who won’t call me back

Your commander has no part in this. The referring doctor is the one who submitted it with those conditions for unfitting. At this point I don't think you can get it added. You will need to try to get it added upon an appeal to the FPEB at the end. That is why I gave you the advice on what to do throughout the process.

I have 19yrs 2 months, my question is, if I do a medical retirement will I be able to take my terminal leave, or will they rush me out the door and try to get me out before I hit 20 years?
