VA compensation and retired pay!?

Hello,

I am currently in my 13th year of active duty with TIS and expect to be promoted to E8 within the next couple of months. Recently, I experienced a heart attack and stroke, and I may also have vascular disease. I’m still uncertain whether I will be able to continue serving, but I want to explore my options in case I need to transition out of the military.

One of my main concerns is whether I would qualify to receive both VA disability compensation and retired pay simultaneously. I’ve researched this extensively, but I’ve come across conflicting information, and I’m hoping to get some clarity.

less than 20 years means you don't get VA concurrently. If your VA compensation is higher than your longevity pension earned you will only get VA compensation. Check out CRSC. If you qualify then you may be able to claw back the pension that was offset by the VA up to the amount you were losing out on due to the VA offset. You do need to be retired to apply and receive CRSC so if the military kicks you out then you get nothing except a severance check and no tricare. So if you get put in IDES its paramount that your unfitting conditions ratings = 30% or higher.

I would hire an attorney if put in IDES and I would do it at the very beginning. I will send you some references if you end up in IDES.
