Good day Gentlemen,

I pray all is well. I just received amazing news from HQMC that I was awarded my retroactive CAR. My next step is to apply for CRSC and I had several questions.

1. What documents should I submit?

2. Do I need to submit an updated DD215 with the award?

3. Should I get a VSO to assist me?

4. If awarded CRSC will I receive back pay from the VA Waiver/Offset?

Congrats! That's a huge win for you :)

1. DD Form 2860 spells out the documents you need to submit, so there's no need to regurgitate the list again, however, ONLY submit the medical documents from POINT OF INJURY and NOT the complete record!

2. Not necessary for the DD-215 unless that award is being used to support your claim, if it's just a length of service award, then you probably won't need to submit. If you have the orders for the CAR that should be good enough, however, if you have the DD-215 readily available, submit it as well.

3. It's pretty straight forward, plenty of info in the group and in my FB group if you need assistance. VSO's don't typically handle CRSC claims, although there are some that do but they're a unicorn if that's the case.

4. Retro pay will be based on your length of service and NOT necessarily your complete offset. i.e., if you were in for only a short period of time, you might only get a few hundred dollars vs a Ch 61 VA offset if rated 70% or higher of $1500 or more. So, retro pay is based on length of service x 2.5% x high average 36 x number of months since retired OR how many months since the condition was awarded, whichever is the more recent of the two. You can also get your monthly payments at crsc calculator | crsc . Holler if you need some help.
 
I would submit the Navmc form if you can access it or if they gave you a copy. I can’t remember what form number it is but it’s the form that is printed from iaps. It will have the narrative of the award on page 2 of that form.

I’m actually a Chapter 61 Retiree rated 50% from a BCNR decision with three years of service. My EAS was in 2007 and my retroactive pay was offset. Will I receive that plus CRSC or how does it work?

You may or may not get retroactive pay back to 2007. You will have to take that up with DFAS once you are approved for CRSC. You are probably going to have a massive audit done by DFAS now that you are retired from BCNR decision. During that audit they will determine if you are owed money by the VA or DOD due to the retro retirement. They might recoup any severance you were paid before paying you CRSC or retirement pay if you received severance in 2007. Also keep in mind you will only be paid up to your longevity pay based on your high 3. So with 3 years in I’m guessing you were a Lance and a Cpl… that will knock your payments down significantly so you might be expecting a large CRSC payment based on the percentage but in reality it will probably be sub 200 dollars monthly. Which does of course add up if you get retroactive pay to 2007. Hell even retro pay for 6 years at 200 isn’t terrible.

Honestly that’s going to be interesting to see how it all plays out.

Furthest back due to BCNR action on a retro retirement would be 2008, sorry to break the bad news it won't be back to 2007 ;) I've worked with several of these cases across the branches, esp Army, with one person getting their retro back to 2012 (their effective date) and one now who is awaiting adjudication of their CRSC claim following an ABCMR retro retirement back to, I think it was 1997. That won't go further back than 2008 as well. The final decision would be at DFAS following the establishment of your first CRSC payment.
 
Everything from your BCNR should be uploaded into your OMPF. Your OMPF can be accessed on milconnect. How long that will take for them to give all the documents to HQMC is a factor and also if they send it at all.

I did go on milconnect and received my OMPF it didn’t have the PEB records.
I do have the original BCNR paperwork that was mailed to me. With the favorable decision and it also has PEB notes.

Would those PEB notes suffice for CRSC?
 
I’m not sure. You would have to call the CRSC board and ask. It’s not difficult to get them on the phone and ask questions, but once they have received your package they won’t really answer much about the status of it. So I would just call them up first thing Monday and explain your situation and they will probably be more than happy to confirm the BCNR part and updated PEB stuff. That will be the definitive answer. They won’t answer questions on if your conditions will be approved.
 
I did reach out to them waiting to hear back. Also would a personal letter from myself and a letter from my battalion commander at the time help my claim?
 
I am pretty sure (I havent read it in a while) that the DOD instruction on CRSC doesn't allow for buddy statements or personal statements outside of what you put in block 13j on the application.

As to the BC statement... I believe the statement needs to be on a Letter Head/Standard Naval Format. This is something I would get clarity from the board.

You are correct, however, the BC letter does not necessarily have to be on a letterhead as a lot of these folks have retired, therefore not entitled to use said letterhead. It DOES need to have email and cell contact info, I don't know if Navy reaches out or not, but the Army does to validate, i.e., Army actually checks the personnel file for wartime chain of command to make sure they were indeed in your chain.
