So results came down today. They flew me out to fort Lewis for my formal hearing tomorrow of my appeal. I brought with me two range of motion reports from two diff docs, memo from employer, and memo from wife. Hearing was supposed to be tomorrow but after they reviewed the evidence they decided...

So i am in the same boat. Had my TDRL reevaluation and the doc messed up my ROM and I asserted that radiculopathy should be rated as secondary. I not only lost 20% But was basically told I dont go to.doctor enough so it seems to be improving. I have DDD and had a fusion. Shit doesn't just...
Yea no kidding. I went to a chiro and a physical therapist and for range of motion tests redone. All under 20 degrees forward flexion. So unsure how the tdrl doc got 45 degrees. Hopefully this is sufficient enough.
So the army also said that since my radicuopathy wasn't unfitting (can't find where you see how it is unfitting anywhere) they will not tack it on as secondary to keep me at 30 % and up. Any ideas? I'm seeing two chiros out of my own pocket to get additional ROM tests done.
Nope. The meds they have me actually controlled most symptoms. Like it's supposed to so do not sure. My formal hearing is in 2 week's. So no way i can even get in for a MRI for further evidence. Just seems like I'm screwed.
So my attorney tried to add the radicuopathy to get it to 30% but no dice. They said I haven't gone to the doctor enough and that the reexamination showed improvement even though I disagreed. So now I have a formal board coming. I am lost. And beyond pissed. I'm trying to get the VA to order a...
Full post that was cut for some reason:
Was rated 40% back by army and placed on TDRL.
approximately 1 year later had tdrl reevaluation with a pulmonologist serving as PEB doc at Madigan. His notes were everywhere and even applied pressure on ROM tests. The combat related info is marked...
Hello there. Underwent my tdrl reevaluation a month or so ago. Receive the findings and woah to appeal. The doc applied pressure and such when doing range of motion tests, wrote some data down wrong. Also how do I go about adding further issues to be found fit or unfit? I need to appeal and...
so my PEB has finalized and I have received my final out date and all that jazz. My question is the promotion. I was promotable. Then after surgeries and MEB I lost it. Ann I to be promoted to SSG upon retirement?
