In the Army your PEB attorney falls under the office of soldier counsel. I would hope these person do not work directly for PEB-its a conflict of interest. Unfortunately I think w assigned counsel or private counsel-I agree the PEB can do whatever they want. Its sad and when there is no rules...
I think OSC counsel is arguably more incompetent and understaffed. Some do not track Seminole case law and now your MEB counsel represents you at PEB. If you get a stinker you are stuck with her.
Hi are you sure about block 27B? Block 27 covers final service member action. The DA 3947 form instructions state, "Block 27.b. SIGNATURE Service Member applies signature verifying they have read and understood Block 27."
30 percent provides Tricare for yourself and dependent and senior service members may qualify for more than what the VA can pay out. I think VA disability payment amount is not guaranteed. I think a med mil retirement payment is arguably more stable-not sure.
FWIW I think it prudent to always submit a NARSUM appeal when you have things you disagree with. It peserves the record for a formal and other appeal options.
You are entitled to legal assistance. You may want to contact them. In addition you need to review the service regulations determining unfitness. In addition to a myriad of DODDs, DODI, and applicable case law.
