VA delay in submitting proposed ratings

I think so. If ur case is at Seattle then u need to start calling them back to back, my case was sent to Seattle on June 9th, and It just got rated on Oct 2nd after several calls and complaints

Sadly you likely won’t get ahold of anybody that can help. The VERA line is disconnected from the shutdown and for anyone else that reads this for the JBSA PEB area their MEB/PEB legal teams are furloughed and not currently working. Probably why DA199’s are held up. You’re supposed to have access to legal. Just found out end of last week.
 
Okay I think I understand a bit more of what you’re asking. I am active Army so obviously our rules might be slightly different, but if you would like to know how the VA sees it, I posted their actual regulation a little further back in this same thread for people to reference for all branches. So, yes, you can be determined to be “fit” after a PEB reviews everything, but look at it as you’re tainted now. If it goes that far to an PEB you likely had a condition that was bad enough to warrant oversight, even if you become “fit” expect to be heavily limited in duties and expectations which the PEB actually determines those limitations, your provider or command has absolutely no say in them. I do know that in the Army that if you are referred to a PEB multiple times for the same condition like you beat it once and get sent back again due to worsening or continuous injury. You have no choice but to be separated from service. Also, you do not get to a PEB unless you go through an MEB which is basically just a verification of the condition and severity by a specific MEB doc. I’m not sure if Navy is the same way, but Army has multiple regs regarding med boards, but they all kinda overlap different stages of the process so there could be another reg in Navy that kinda combines with that one you stated.

Well, I’d need some more info. Has this person been to an IPEB and found “fit” this matters due to the IDES process being DoD mandated. I can speak just a little to this proves as I’m active army and attempted transfer to active airforce and it didn’t work out due to medical conditions and what they were willing to offer as jobs at the time. To answer your question that you asked with the information you provided, I’d have to say, I’m sure you could do a transfer, but as I said in my message, most people who beat an IPEB and remain in service likely are heavily profiled and or limited in job duties or expectations. Seeing how the IDES process is DoD wide you couldn’t hide it and likely everything medical wise is free game and one could assume like with what happened to me they wouldn’t risk a transfer with limitations and such. Please reach out if you can give a bit more info or I didn’t answer well enough. A reg is a reg and they must abide by that as it’s a DoD reg or an instruction specifically based off the current info you provided it is possible.

I had 25 total conditions, one of which is an extremely rare disease and the VA doesn’t even have it in 38 CFR.

As of today at Ft. Hood/ JBSA the MEB and PEB legal departments are furloughed, so hoping to hear from PEBLO maybe next week or the week after.

I think you and I are on similar timelines with narsum signed around jun 23 and unfit around jul 15. Have you heard back about ratings or see anything on the va app?

So yours might come back in a week or two, just cause you were found unfit mid July, I’d say end of October as a safe bet. On the VA app it’ll say received and closed the same day.

Congrats dawg, I haven’t heard anything from IPEB since I got my rating probably due to the shutdown but I’m hopeful anyway. Let me know when u hear something back, I have been trying to get a contact for IPEB to disturb them but it hasn’t been successful as I couldn’t get hold of a number to call
