Referred to ND-PEB for chronic PTSD

How do I get a duty related determination with this... I have a Purple Heart from combat in 2005, that started all of this... but the evaluator somehow decided it was non-duty related and that counseling records and VA records don't support in line of duty?

What is my best option from here? I"ve uploaded the "elections" they gave me today.

You will have to build a convincing case that meets the standard. Gather all existing medical documents that support what you are saying. The PTSD DBQ has clear requirements for each percentage level. Review that area to see where you believe you would fit.

Go get outside treatment and corresponding documents. The Vet Center offers counseling.

You could also consider finding doctors willing to complete a dbq. Be careful as many of these places are over priced and can be untrustworthy. Ensure that the doctor signing your dbq has the required qualifications the VA needs. So for mental health a psychiatrist or similar qualification is typically required. If an MD signs they can decide not to use it.

Write a detailed personal statement of the experience which started your PTSD. Link it to your awards. Make it as obvious as possible to anyone reading it. This can be very emotionally taxing. Maybe consider doing this with the help of a counselor.

You can also have others make written personal statements that can be submitted such as a spouse or people you served with.

Reach out to JAG and alert them to this situation.

This packet will then serve as your evidence countering the findings that lead to the non-duty classification.

My personal statement ended up being 8 pages. I submitted to the investigating officer for LOD determination. That combined with awards statements allowed me to secure an LOD 13 years after that deployment.

And each time you are asked to sign something, ensure you include a written protest.
 
THank you. The funny and frustrating thing about this to me is that VA already rated my PTSD at 70%... I've been to the Vet Center as well and the person who filled this out had those records.

What branch and guard or reserve?

Then you need to find your MSC. Not the VA MSC, but the enlisted guard MSC. This soldier is processing all your paperwork likely at battalion or brigade level. See if they will work with you and get you connected to the correct people to change from non-duty to duty. And ask to submit for a PTSD LOD investigation. There is no time limit on mental health LODs for PTSD. You will need that packet I referenced earlier for the LOD investigation. Do not let them discover things. Tell them clearly through the paperwork.

Agreed. Push for that LOD investigation...firmly but polite. It helps to have the MSC and command on your side. You must help by spelling out the connection between your experience/s and the current PTSD. The advantage you have is that you are already diagnosed with PTSD and have clear combat incident paperwork. You just need to clear up the "why" on their end.
 
You definitely DO NOT want to “Waive your rights”. You can request counsel. We are dealing with this exact thing now. The NG is fighting us all the way.

@JustaGuyPHOIFIII You have a Purple Heart from combat, that should be all they need to know as to why you have PTSD, but they dont want to pay you what you have earned, and deserve. Thank you for your service to this country!!

Here is a phone number I found for the Office of Soldier’s Counsel- 706-787-2476/8734. We are in KY, so I’m not positive that number is relevant to you, but they should be able to redirect you if not.

Had a long chat with the officer manager, BH specialist, and Health Services officer. They advised to non-concur and said that HRC will adjudicate the line of duty and this is the process they have to go through. It seems a little backwards to me.

My path was similar. Keep pushing and build your case while this processes.
