I've had it up to here!!

I began terminal leave in March of this year. The day I received my DD214, I have a copy to my PEBLO, MSC and also turned on in to my local VA. My last day of Active Duty was 27 Jun 14, so my "new" claim was opened on 28 Jun 28. There was no activity at all on the claim until 29 Aug, which...

    Pending Decision Approval 9 weeks

My claim never left the "Pending Decision Approval" phase. However, in my case, it was in the "approval" phase for approximately 9 days. I had assumed I had a few more weeks to go, but my PEBLO called me that afternoon to let me know my rating were in. I know it is frustrating, as everyone...

    Final Ratings: Preparation for Decision

Hmmm....I have been in the "preparation for decision" phase for 90+days. The estimated claim completion date was 9/26/14. I don't see what is taking so long, all of the paperwork has already been written in the IDES process. In fact, this phase, during IDES only took 31 days.

    Ebenefits claim status update

So, after being medically separated with 100% VA proposed ratings (Jun 27th), I am finally able to check my Ebenefits again. Tonight, I noticed that my original claim from the MEB had been "closed". A new claim was opened on 6/28/2014....which I completely understand. What I don't understand...

    Decoding the 199

Warrior, I completely understand! My assigned attorney during the initial MEB portion was simply useless, and has subsequently been relieved of duties on the SMEBC.

    Decoding the 199

My current DoD rating is 10%, with proposed VA Rating of 100%. I currently have 12 years AD service As far a recopment, it is my understanding that the VA will recoup at the 10% disability rating (about $130 a month), until the full amount is recovered. Is this correct? At that rate, my...

    Decoding the 199

Maparker, My last post got me to thinking....is there any provision under V4 for aggravation of the original injury? In my case, I had been doing fairly well, with moderate daily pain (4 out of 10 on average), until my most recent deployment. Having sustained an 80lb IED blast while conducting...

    Decoding the 199

Thank you both. The big thing is that is is not taxed....thank GOD. Maparker, I understand what you are saying, but the narrative on the 199 for V4 is misleading, as it states "disability incurred in a combat zone OR incurred while performing combat-related operations as designated by the...

    Decoding the 199

While preparing to meet with the attorney on monday, I noticed what may be inconsistencies on my 199, and would like some help to determine if my train of thought is on point. The narrative on my 199 for Disability 1 reads: "The onset of this condition began in 2005 when he lost consciousness...

    On to the FPEB....need assistance

I will meet with the attorney on Monday. In the mean time, I am compiling my civilian treatment records for the past year, as well as going through all military records to show history of radiculopathy. My last assigned attorney was less than stellar on the MEB Appeal, so I am making sure all...

    On to the FPEB....need assistance

While I am EXTREMELY pleased with my VA proposed rating of 100%, I am less than pleased with my 10% from the DoD (Army)! My only unfitting condition is: Lumbar DDD, DJD, IVDS = 10% Fitting conditions: PTSD - 50% Chronic Fatigue - 40% Urinary issues - 40% Peroneal nerve palsy w sciatic L lower...

Once the door opens to the FPEB...?

Very interesting questions! I do not have the answers for you, but will be monitoring this post, as I have been wondering the same. Good luck to you!

    Stopping the MEB/PEB process

Thanks for the information. Luckily, the tumors turned out to be hemangiomas. However, I will still consult with a surgeon to determine wheter or not removal is an option, as they may be causing my significant neck/shoulder pain. That brings me to my next question....what is the process of...

    Stopping the MEB/PEB process

Currently, my packet is in the "pending decision" phase with the VA. However, last week it was found via MRI that I have 3 tumors on my lower cervical and upper thoracic vertebrae (C5, T1,T2 IIRC). At this point, we have ordered more studies to determine if these are benign or malignant. I...

Need help ASAP....IMR may be tomorrow!!

Warrior, I applied for SSDI. For months after applying, I attempted to contact the individual who was handling my claim, in order to ensure it was looked at under the provision that I am a Wounded Warrior/MEB Soldier. After 30 messages left for her, she finally had the decency to call me to...

Need help ASAP....IMR may be tomorrow!!

What next? Well, I just received the preliminary memo, stating that I was unfit (for DDD) and that my case would be forwarded to DRAS for percentages. Once the percentages come back, will determine how I proceed. If less than 30%, I plan on requesting a formal board. According to my...

Need help ASAP....IMR may be tomorrow!!

Got my appeal back today, and as expected....no change. I will paste the response from athe apellate authority, as the general tone of it felt unprofessional, and generally annoyed me: "23Sept13 Appeal Reply: Regarding PTSD, I confirm original findings. The unit PA and CPT medical provider...

Well, got the results of my IMR, and I wonder if the Dr's even looked at my medical records. I will update this once I have a chance to. Right now, I am attempting to put together information for my appeal. However, I urge everyone who reads this thread....KNOW WHAT IS IN YOUR MEDICA...
