Earlier this year i got arrested for a DUI less safe off post and was given a local GOMAR and released for standards for my unit to go to the conventional army. The GOMAR was locally filed based on letters from my entire chain of command - i did and have continued to take responsibility for my actions, have been a hard and trustworthy worker, and was vouched for. Recently I had a mental health emergency and was referred to an IOP clinic for SI, and upon returning i was told by my chain of command that i would be referred for a Chapter 14 (for the initial DUI). At the same time, I was referred for a Medboard for significant hearing loss (service related) necessitating a Cochlear implant. From the legal standpoint, the DUI case has already been resolved due to factors (borderline BAC, no speeding, accidents, etc), although i continue to take full responsibility for my actions.
I do not believe my COC has initiated the chapter yet because nobody is tracking it, but the MEB is already in motion, my DA 3349 reflects it. My question is how both processes will interact - will the chapter override the medboard? My chain of command had no intention of medboarding me before i was admitted to the IOP. I reached out to TDS but was told i could not have legal advise until the chapter is formally put through.
I would highly appreciate any feedback, anecdotes, or advice at this time.
