My husbands proposed ratings came back today. DOD rated him at 10% and the VA at 60% for DDD. We ran into a slight issue as legal and the PEBLO realized that he was not given a ROM exam at his C&P. His last ROM exam was performed at Landstuhl before we PCS'd back to the States. We have an appointment with Legal on Thursday, but I was wondering if there was anything else we should ask about? We are not happy with the 10% as we feel all the right steps were not taken into consideration for his ratings. Any advice will be greatly appreciated.

So is the 60% VA just for the DDD?
No the 60% is a combination of conditions, the 10% DOD is just for the DDD

Sounds like you are going to have to do an appeal at the FPEB. I know it's past but your PEBLO and Legal should have caught the absence of ROM at the MEB level before case being sent to PEB. ROM is essential to proper DDD ratings and evaluation. Anyway, I would be asking, "how are we going to get ROM test, so that we can submit the ROM score at appeal with FPEB?"
Make sure to go over the entire MEB packet with a fine-tooth comb...because if they missed the no ROM, there's probably more errors.

IDES and Legacy are separate programs. Legacy should not be used anymore--as it's the old Disability Evaluation System (DES) process. I understand that you guys are in IDES...so your reference to "the legacy code" is a bit confusing. Just need some more context to the code 1. Please.

On the VA proposal, it has a table that has legacy codes. There's an additional service code column being "1", a combat code column being "1". Some people have said the "1" meant not combat related, while others have said it was combat related.
I wish I were at home so I could pull out my VA Proposed Ratings Letter...but I'm not.
The VA isn't really in the business of designating conditions combat related or not. That should be on the 199--thing that comes back from PEB with the DDD and it's rating...
Is the one next to each condition listed on the VA proposed ratings? It may mean "service connected". I'm not sure...

Yes, it's on the VA proposed ratings sheet. I just wish they gave you a legend to follow lol, guess we'll have to wait til Thursday to ask Legal. Thanks so much for your help thus far

Does anything come after the 1? If not (I think I found it) it indicates "no combat disabilities". Do you feel the DDD or any of the other conditions should be combat related?
The injury is combat related...he also has a V4 code, which I'm pretty sure means our severance is not taxed. I'm just trying to figure out if the VA will recoup the money or not :/
Ok...well, if DoD has it coded as combat related then that's something you want to bring up with legal to verify that they have it coded properly with the VA.

The legacy DES is unfortunately alive and kicking. DoD gave the Services the ability to continue using the legacy system for new entrants and for cadets/midshipmen. The legacy system is also used during TDRL revaluation.
