Friday 4 October my PEBLO calls at 13:00 to tell me to come see him Monday Oct 7 at 10:30. I can’t blame him as I might have done the same. So I waited all weekend and low and behold 70% DOD PDR Combat Related and 100% VA, proposed, I am very pleased. My PEBLO wants me to chase 5 + % more DOD. I don’t know, because the reasoning and rational behind my ratings seems fair and accurate. Also the smart thing is to leave the service around the 27th of the month to hopefully only have a month + 3 days to wait on pay. I don’t have enough days to stretch to the 27th of January, so I would have to accept a little less than 90 to be placed well in December. To request a formal PEB just to add days seems a little less than ok to me, (For me, each of us is the true keeper of their conscience, I can only deal with how I would view myself. I do my best not to judge others). I haven’t been able to get legal to see me yet, but the 199 reads in a very uncomplicated manner (at least mine does) it’s straight forward with clear statements. I know my PEBLO wants to help, but there’s nothing there I was rated well and in my opinion correctly. So I am now free to start to handle everything with my transition and out processing, in a really small window. But that is ok as well. Thank you Folks! I adjusted my timeline and my ratings came out of Seattle.

By the way, if you are satisfied with the IPEB findings inclusive of DoD PDRL and DoVA proposed ratings then there doesn't exist any need to try to "chase 5 + % more DOD" in my opinion.

To that extent, enjoy your forthcoming military disability retirement to include all of your post-military endeavors! ;)

Oh yeah, no problem. The older ones are basically useless information. Start somewhere around, say, June. At the bottom left, click on Aggregate and scroll down to Seattle. It is listed last. As you look around, you'll see that Seattle is definitely not the best place to have a claim, but it is far from the worst. Their processing is getting better and better. I hope that the 10-day stay encourages those good people to work faster so that they have less of a pile up if they get furloughed and finally return to work. God bless them all. Average processing at first of June was 275. Now it is 160 just 4 months later.

Food for thought, I received a phone call from my PEBLO this afternoon notifying me that the "case workers" obviously not talking about herself, I believe she was talking about the VA rating personnel, were being furloughed and that my case is going to take longer than expected. I'm at 83-ish days waiting for PEB completion (ratings)
 
6/15/13 - Unfit memo sent to Seattle from Fort Bragg.

I finish six months in december (during christmas timeframe) and that's where my my ratings will come back as per my PEBLO.

How many days I will have to respond to the ratings to non concur ?
 
That is 10 days, not 10 business days. You may get an extra bit if that time falls in a DONSA.
 
VA is only furloughing the non IDES or DRAS personnal that means if you are MEB out of the service you will still be helped. Also the PCS on hold doesnt apply to ETS or retirement and MEB personnal

Well this is great news! Hopefully the MSC's that are furloughed at our individual installations won't keep our ratings from coming back and I can receive my "PEB results"/ratings and 199 without them being there; if it were to come back during the shutdown.
 
Claim status on Ebennies went to Pending Decision Approval on 7 October. I called the VA 1800 number yesterday, and the rep told me that my preliminary ratings were completed. Today it's now showing Gathering of Evidence on ebennies. Am I missing something and starting all over? Or does that just happen when they finish the preliminary ratings?

Your ratings are proposed and sent back to PEB for your 199 to be completed

Whew! Alright that's awesome. I guess I'm out of the "black hole" of the MEB process now lol. Any idea of how long the PEB takes to complete the 199, and send it back here for me to sign? Or is it now onto the next waiting game?
 
Mine took 21 days; after the VA sent my ratings in. It depends on the work load and unfourtunatly the shutdown (if its affected the civilian staff of your PEB). On a good note quite a few of us had the ratings sent to the PEB before the shutdown, and have gotten our 199's during. just plan on three weeks to a month.

That's not too bad. Hopefully the shutdown doesn't affect it too much. Thanks.

Indeed, my DA Form 199 took approximately 14 days after receipt of my initial DoVA proposed ratings.

Then, the Reconsideration #1 DA Form 199 took approximately 17 days after receipt of the VARR results of the initial DoVA proposed ratings.

To that extent, stand your ground; never default acceptance to potential injustice since it could potential result in favorable dividends upon completion of the DoD IDES MEB/PEB process! ;)

From my experiences within the DoD IDES MEB/PEB process via an U.S. Army perspective, I offer the following responses:

Q1. Chronic bilateral testicular pain(Unfit)
A1. I am not sure how this shall be be potentially evaluated. But, in my opinion, a DoVA 0% noncompenesable proposed rating could be determined.

Q2. Chronic PTSD(Unfit)
A2. Either based on the degree of occupational and social impairment or based on the 38 CFR 4.129. Upon adjudication, your medical condition:
  • If rated based on degree of occupational and social impairment, then a maximum DoVA D-RAS proposed rating of 100% down to a minimum DoVA D-RAS proposed rating of 0% could potentially result
  • If rated based on 38 CFR 4.129, then a minimum DoVA D-RAS proposed rating of 50% shall result with a re-evaluation in at least 6 months
Q3. Migraines
A3. A noncompensable evaluation will potentially be assigned unless there are characteristic prostrating attacks averaging one in 2 months over last several months. Need to show proof of "prostrating" attacks so it's in your best interest to maintain a comprehensable log.

Q4. Left knee pain (Army says left knee pain, VA says normal function - I haven't ran in months for it to act up during C&P's)
A4. In my opinion, primarily dependent upon Range of Motion (ROM) measurements unless there exist evidence of painful motion of the knee (38 CFR 4.59) which assigns a DoVA 10% proposed rating.

Q5. Bilateral hearing loss (Army says hearing loss, VA says normal hearing)
A5. In my opinion, the assignment of a "proposed DES Not Service Connected, Hearing Normal for VA purposes" determination.

Q6. Tinnitus
A6. In my opinion, it's a DoVA 10% proposed rating; the hightest scheduar evaluation allowed under the law.

Q7. Scar from varicocelectomy
A7. In my opinion, it's a DoVA 0% noncompenesable proposed rating if it neither painful nor unstable. A higher evaluation of 10% is warranted if there is a superficial and nonlinear scar or scars not of the head, face or neck in an area or areas of 144 square inches (929 square centimeters) or greater.

With that all said, it's a good deal with the "Fast Track MEB" at Fort Hood. Hopefully, all DoD IDES parameters are still being executed properly to the required standard.

That's actually one of the reasons I finally registered. In hopes that through all of this, I have gained some knowledge that I can give back to this awesome community of fellow Wounded Warriors and may be able to help answer questions based on my experience.
