199 came in yesterday. They addressed my issues post surgery, but as I expected, they never rated the hip replacement itself. So, knowing that, should I appeal, demand a formal PEB? Lawyer says I have great percentages. 60/90. Not sure what to do.

Here are my disabilities on 199:
9411 PTSD 50%
5251 Strain, left hip, Status Post left hip replacement (scar not unfitting) 10%
8626 Peripherial neuropathy, left thigh, status post hip replacement 10%
5252 Strain, Left hip status post left hip replacement, Limitation of Flexion, Impairment 0%
5253 Strain, Left hip status post Left hip replacement, Impairment 0%

There was a lot on hip replacement, yet no rating on 5054. My 3947 (MEB proceedings) has the diagnosis of: S/P left hip replacement with residual scar.

Not sure how the PEB and VA missed this one. I need help, I really dont know what to do, I want it corrected, but also not interested in staying in anymore. Suggestions?

Congratulations on the recent receipt of IPEB findings inclusive of DoD TDRL and DoVA proposed ratings! :)

Indeed as I totally comprehend your rationale, but ultimately it's better to fix all potential injustices while within the DoD IDES process than as a military veteran via the Army Review Boards Agency or similar sister service agency in my opinion.

To that extent, I would ask the question "What's more important to you...potential DoVA correction later or potential military retirement now for peace of mind?"

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

Hopefully someone can either confirm my assumption or readjust my head space and timing here. Spoke with DAV last Wednesday after my ebennies jump to preparation for decision and then on to pending decision approval. DAV rep gave me my ratings and the breakdown of them and with my did rating it was apparent that they didn't include the 70% for PTSD the did rating of 40%. My two other unfitting conditions are both of my shoulders which were rated at 20% each. On the 21st ebennies changes to gathering evidence and requesting separation documents, great I should be getting my 199 soon. Well I haven't seen it yet and I know it hasn't been long enough but something told me to look at ebennies and on the 27th it went back to pending decision approval but it still has the requested separation documents.
My theory is that the 70% for PTSD not in my DOD 40% combined rating was caught at the PEB and was sent back. Which is what I believe caused the sudden shift in ebennies back to pending decision approval.

1. Does this theory sound logical?
2. If not, please let me know what y'all think is happening.
3. I know that the DAV rep and/or my MSC/PEBLO could shine some light on the subject but they don't like to explain anything in detail at all.

just a little more information on the strange series of events: my unfitting conditions were PTSD and both of my shoulders, I have a few other rated conditions that bring my VA rating up to 90% but I'm just curious as to the "back tracking" on ebennies. Strange situation, even the DAV rep caught it and was saying that my DOD rating was jacked up. Honestly I don't care about the DOD rating at this point because the money that I miss, will make for a much larger back payment by the VA sometime next summer. I have a job and was to leave ASAP. Can't wait to get on my 75 days of transition leave and go to work at my new job. I'll be catching up on bills and paying back the Black Friday madness that my wife is going nuts on as we speak, and no i'm not participating... I've got better things to do, like sitting in my warm house listening out for the babies while they sleep and apparently browse the PEBForum. And the ambien is kicking in so please disregard my lack of organization in this post. Hope it was as much for y'all to read as it was for me to type. SQUIRREL!

No, actually. My PEBLO called me Monday morning and said the ratings were done and sent the previous Saturday (7 days ago now), and Tuesday I got an IRIS inquiry response back after 3 weeks that said the same, and the next email was from my MSC at Campbell, same message. -Preliminary ratings complete, sent to PEB, Letter sent to you, don't call PEBLO, he'll call you.
My PEBLO still wouldn't tell me my ratings. Sounds weird. Maybe the ratings are high? I don't understand why nobody will tell me my proposed ratings. Input/reply appreciated!!! What do you think?

Additionally, my PEBLO also sent me an email asking me for my latest NGB23 so he could go ahead and do some prep work before my arrival. I sent him that right away as well as my end of NOV LES.

Alright, today was a good day. Showed up on TRANSPOC today. Immediately jumped into action. Since I need to be out and moving I am trying to avoid the long delays to get orders that people are seeing at JBLM. I have succeeded in gathering all my documents and have an approved Leave form with PTDY to take to the briefing tomorrow. Hopefully, the powers that be comply and work with me.

Start Transition leave 13-Dec
Retirement Date 16-Feb

I'm also at JBLM and signed my 199 Wednesday. How long did it take for you to show up in TRANSPOC?
 
there's a guy in my unit who called the va and the va said they sent his ratings on 01Nov2013 however, he still has not received anything, of course his peblo says she hasn't received anything either. Anyone care to comment seems like a really long time as it will be December next week.

Indeed, hopefully the PEB received the DoVA proposed ratings but they are still adjudicating his DoD IDES case file at this point.

Otherwise, his PEBLO could taken some initiative to contact the PEB and make an inquire as to their receipt and/or look into the ePEB system to view the information available about his DoD IDES case file.

My PEBLO has said to me that its back at the PEB. He say's they've been reading over my case since the 14. Though I do not know what this guy is talking about. I called him on the 15 saying I the VA finished my proposed (thanks to ebennies), and he told me keep in touch. So I do my usual call on wednesday for my "update". This guy than follows to say,
"Hey call me every day and we will see if they did something". He yelled at me for calling too much cause he told me to call everyday haha. Best part, he is going on leave until Friday. Whoop Whoop.

I asked if he know what my proposed were or not, but he said "I cant even see anything that you can see" and I was like arent you the PEBLO and can see mostly everything that is going on, he followed with, "I can but don't have time to look" and I was like wait what... and he was like, "i dont wanna look right now"

My IDES has said UNKNOWN for about 10 days now, and its frustrating but I've been reading y'alls responses which have given me some hope. So thank yall haha.

It took a week for me to show up on TRANSPROC.
 
quick poll for those nearing the end. how much time are you averaging from receipt of unfit memo to receipt of DA 199/unofficial receipt of ratings? the Dashboard says ~150 days, but it seems like some on here are in the 90-120 day window.
 
Is the dashboard information based off the Army as a whole or the specific PEB your assigned to? If so maybe that is why we are seeing quicker turn around times for most.
 
Army as a whole I believe. Most of our cases go to Seattle, but I think a few go to others. I'm at 60 days right now since receiving my unfit memo; O-3's and O-4's have a pending officer separation board (this Spring--potentially up to 30% reduction in force). They haven't announced the particulars yet, only stating that the proposal is with the Secretary of the Army, but I'm hoping mine follows your timeline so I can transition prior to any officer separation boards convening.

A few lawyers have said that the RIF shouldn't affect IDES, but IDES cases were considered when the SERB (selective early retirement board) met in August and they just said they would handles IDES on a "case by case" basis--whatever that means.

Well I will be over 120 days at the VA this week so I hope I'm done soon.
 
I'm between VA being done and the PEB sending up the ratings and 199 to my PEBLO. It has been 9 days at the PEB so far, army average is about 11. We'll see.
