Unfit memo

I have read through the forums to try to understand what the "V" ratings refer to and how they will relate to me but it is hard to try to find a solid answer so I just wanted to ask about my specific case. Hopefully someone can shed some light on this for me. My unfit memo has me unfit for chronic shin splints, V1-yes, V3-yes and V4-no. What started it all was when a M3A3 bradley 25MM cannon (the lower receiver, about 120 lbs) was dropped on my leg. It wasnt downrage but in the field when it happened. Any idea what those mean in realtion to my specific case? Would severance be taxed in this case? I have no idea what to expect for anything so any info would help. Thanks.

FOR CRSC APPLICATION YOU NEED TO MEET THE REQUIREMENT AND WEN YOU GET OUT OF THE SYSTEM FILL AN APPLICATION IS A SEPARATED PROCESSES FROM THE MEB/PEB

FOR YOU QUESTION I BELIEVE YES YOU CAN APPLY FOR CRSC WHICH MAKE PORTION OF YOU RETIREMENT TAX FREE NOW THE FINAL DECISION IS FROM THE CRSC BRANCH

Exclusion from Federal Gross Income

Disability severance pay is excluded from Federal gross income under the provisions of 26 USC 104 if the member had a military status or obligation on 24 September 1975, the severance pay is awarded for a disability to be combat related, or upon application therefore, the Soldier would be entitled to receive disability compensation from the VA.
The PEB Record of Proceedings will document determinations of Soldier's status on 24 September 1975 and combat related.
A disability is considered combat related for purposes of exclusion from Federal Gross income, if it meets one of the criteria below. For more information, see DoD Instruction 1332.38, para E3.P5.2.2.
As a direct result of armed conflict.
While engaged in hazardous service.
Under conditions simulating war.
Caused by an instrumentality of war.
Due to limits of the current DoD Defense Finance and Accounting (DFAS) pay system, taxes will be withheld on active duty cases separating with severance pay. Procedures exist for the local servicing finance office to coordinate with DFAS-Indianapolis for refund of the taxes withheld. The request and required documentation must be received at DFAS by 31 December of the year in which the severance payment was received. In the alternative, the Soldier may seek a refund when filing their tax return. For more information on filing with the IRS contact the Servicing Finance Officer or USAPDA.

4. The disability severance pay was awarded for disability incurred in a combat zone or incurred while performing combat-related operations as desighnated by the Secretary of Defense (10 USC 1212) " V1-YES V3-YES

Depends on DOD % if he gets severance or retirement

Thank you for the responses but I am still slightly confused about what all of this means and what to expect. Sounds like it would bet taxed but I would be able to get the money back? Is that right or am I missing anything else?
 
No rating yet, still just wating. All i have right now is the unfit memo, so like everyone else just a waiting game.
 
On my AF Form 356 it says "No" in the column for combat related when it should be coded for conditions simulating war because my initial injury took place during a stateside TDY at an ORE (ORE or Operation Readiness Exercise is an AF deployment wargames for those who may be wondering). I am only getting 10% DoD and a severence. What are your thoughts @maparker and @Jason Perry ? Is it worth the wait of the Advanced Adjudication and possibly a formal board since I am not eligible for retirment?
 
What is your VA rating?
60% according to his time line, since the final claim closed out last month.


Is there anyway that a formal board to fix the combat related condition could be paired with a serious and honest case to have any of those additional 50% worth of claims added as unfitting to get you 30%?
