IPEB findings came back Monday

I received 30% permanent retirement.

20% Anterior tibial nerve- due to my surgeon slicing through it during surgery. that sucks
10% for complications with scarring

As I noted in an earlier post, according to the JAG office, whether or not my injuries were combat related is a "gray area" because they happened during SF Training exercises. I've been told I will never run again. I have constant pain, drop foot, involuntary spasms, twitching, fire-like sensations, stabbing pain....etc. As explained to me by numerous neuro docs "cut or freyed nerves do weird things".

Anybody think an appeal would be worth it? I have around 15k in unpaid enlistment bonus remaining. Still not sure if I'm getting that or not. I still ned to be rated by the VA. I wish I would have discovered this board sooner!

Congratz on your findings. Not sure if you have trolled the forum and seen the post's tracking IPEB time-lines or not. I am tracking packages just so everyone on the board can get a feel of what to expect. Do you mind sharing the date your package was sent to AFPC/IPEB, when you got your results? Thanx!

You're pain sounds exactly like mine and I've been diagnosed with Reflex Sympathetic Dystrophy (RSD) aka Complex Regional Pain Syndrome II. Here is a great support site: PhysiciansforPatients - Created by physicians. Made for Patients. You need to bring this to the attention of a pain management specialist as they are best at diagnosing this disease. I also had the tibial nerve cut during surgery, have drop foot, burning pain, stabbing pain. These are all classic RSD and if you have it, you were probably underrated. It was specified in my MEB, but not rated at all and I have since appealed. This would be the rating criteria to be used for RSD alone. In My case, it would be a minimum of 60% due to the severe atrophy.

The code for RSD is an analogous code, which means you discard the first four digits (they only indicate that it is analogous). That leaves the code for 8720 (the 8520 is preceding 8720 and is the code used for RSD affecting the lower extremities):


8520 Paralysis of:
Complete; the foot dangles and drops, no active movement possible of muscles below the knee, flexion of knee weakened or (very rarely) lost.................................................................................... 80
Incomplete:
Severe, with marked muscular atrophy.................... 60
Moderately severe ................................................. 40
Moderate............................................................... 20 Mild ............................................................... 10

I am unclear why the combat related would be a "gray area." Can you provide more details about the circumstances?

The above percentage comes from a report on outcomes from the IPEBs and FPEBs. While I do think this is good info to be aware of, at the same time, I always caution folks that because the facts in cases are different, it is not a good idea to look at how others did without reference to the specific facts of the case and the potential risks and benefits of any appeal. This is not directed at Govols' case specifically, more as a general comment.
 
Two doctors thought I had RSD while another wrote it off completely in about 5 minutes. The one who dismissed the RSD diagnosis apparently caries more weight than the other two because there was zero mention of it in my NARSUM.

As far as the "gray area", the MEB counsel at Walter Reed and Womack both decided it was best to pursue an appeal. They said anything any injury simulating war during an FTX during Special Forces Training should fall under the guidelines.
 
I meet with the PEB on Monday morning and the Reconsideration Memo has already been drafted. Assuming all goes as planned and I retire at 30%, can I ask that RSD be considered at a later date or do I have to stop the process and start over before signing anything Monday?
