Trying to get a gauge for the approximate future timeline now that an unfitting decision has been reached.

Timeline:
June 2015 - Seen initially for plantar fibroma on R. Foot. Orthodic insoles were issued and did not help.
July 2016 - Fell ~2 stories into a hole while deployed with Special Operations. Injury was during standard PT, not combat or training related.
through July 2017 - Navy physical therapy treated chest injury with near no results; Strung me on multiple Light duties
Nov 2017 - First period of LIMDU - Chest injury - suspected costochondritis
Series of poor referrals that I wont get into that couldnt confirm or do anything
Apr 2018 - Second period of LIMDU - Chest injury + Plantar fibroma as fibroma had trippled in size and was now preventing running and standing.
Series of poor referrals that I wont get into.
Oct 2018 - Third period applied for.
Jan 2019 - Third period denied and resubmitted
Apr 2019 - Third period denied again / begin C&P
Aug 2019 - C&P Complete
19 Aug 2019 - Package submitted to PEB.
22 Oct 2019 - VA System is showing Unfit determination per phone conversation with PEBLO.

Just to clarify as its been hard to pull out exactly what happens next. I believe the future looks something along the lines of:
14-30 Days - VA returns ratings to PEB
15 Days - PEB provides official response with proposed DOD / VA ratings. Option to go to formal board.
10 Days - Window to accept proposed ratings
30 Days - Formal board process (if selected)
30-60 Days - EAS / Retirement date

I am anticipating an end date of end of December - mid February. Does that seem in line with what others are seeing or is that aggressive? As an added bit of fun, my selection board results should be releasing at the end of December. Assuming I am retired, it is in my best interest to ensure my final date is post the board results so I can be retired at select grade vs current grade.

Thanks in advance for your help!

I just received my ratings back on Monday after having them sit with the PEB waiting for VA proposed ratings. I can tell you every case is different and no two timelines look the same, but you should receive your proposed ratings and unfit determination here shortly. I would keep in contact with your PEBLO about it.

The way I understand it, once you accept an unfit finding, you are no longer eligible for promotion.

Have you called MMSR-4 yet?

I'm around the same time as you.

May 1 MEB
June 6 MEB complete.
June 28 PEB accept package
Sept 30th PEB forwards to VA
Nov 6th VA sends ratings back to PEB

Spoke with PEBLO today estimated 3-6 weeks turn around of "Proposal Disposition", Per timeline goals this is to take no more than 5 days. Per other branches it looks to be taking about 5 days.

But guess what, you then have only 6 days to return an answer to the PEB from when they send it to the PEBLO(not from the time it reaches you). If you do not return it to them, it is an automatic acceptance. That turn around time frame you have is not 6 business days, or working days, or excluding holidays, you have 6 days and if weekend/holidays come through oh well.

Formal board will most likely take longer than 30 days. Per ides timeline goals, it is to take 24 days, the appeal 21 days, 4 days for rating reconsideration, and 11 for final disposition. That's 60 days. * Per the goal timeline PEB was to take 11 days for the informal, it took 94 days for me, proposed ratings was to take 20 days, it has taken 37 days. 5 days for Proposed disposition is to take 5 days, i'm being told 3-6 weeks.

Transition phase is 32 days + how ever much leave you have on the books, you can request sooner through MMR4 or they can just post sooner if they choose.

Its gonna be a little longer than I think you might expect, and I'm living that right now. Its frustrating as hell.

Thanks for that! I totally missed this reply.

Still havent had the VA return the results to the PEB... I honestly dont really understand the "ides goals" when every time I have asked "what are the requirements on the PEB and other areas regarding timelines" and the answer consistently is well they dont really need to stick to anything.

Based on your timeline and what lawyer/PEBLO have said, they anticipated something prior to thanksgiving but didnt get anything from them so thinking ill hear back on the VA % sometime this week.

Im sure that Christmas will only really screw me on timeline and add 2 weeks to make it 5-6 after the ratings come in.

Do you know if MMR4 consults you prior to setting your date? I have quite a bit of time on the books... 65ish days now, and anticipate that to stabilize around 70.

Unbelievably frustrating as we go about trying to set up gainful employment.

Logged into the va portal today and shows my claim as closed on 3 Dec and decision letter mailed.
It directs me to e-benefits to see my ratings in the meantime. When I go to the disabilities page in e-benefits it is showing N/A for the rating. When I click on the specific conditions, it says "Pending Decision Approval".

I called the VA line and they confirmed that a decision letter was sent to my home address. This surprised me as I believed it was sent to the PEB exclusively.b

I know I can speak with my PEBLO on Monday for an answer, but does anyone know of a way to either backdoor the system or another location I should be looking for that proposal?

Thanks!

It will be sent to you PEBLO and ebenefits won’t show a percentage until you turn in your DD214 if I’m not mistaken.

Spoke with PEBLO this morning. Ratings came back much better than I thought they would. He only told me the total rating. Has anyone been successful in getting a breakdown by condition or is that past what they are able to see?

When you accept your findings, it will tell you what condition was rated and for how much.

Ok so 10 days from the date the va send out ur letter you can call them and have them fax it to you with all of ur findings and breakdown and base off that you can also do the math and figure out what your dod percentage will be by adding up only your unfitting conditions that’s what I did

That's awesome! Ill have to call in a favor from someone with a fax machine!
I have two possible unfitting conditions right now. To my knowledge there is no way to know what the board chose (either one or both). Gardner mentioned the only way I know to see the exact conditions. Is there a method to get that I am unaware of?

No exact way to know if it’s one or both I just do the math so I know where I should fall in between worst case best case

Just spoke with the PEB today. They are quoting 45-50 days now from VA sending their results to the PEB. If an appeal is required they are saying an additional 90 days after the appeal is filed until those results will come back in (60 for the hearing, 30 more for results).

This seems to be getting out of hand and significantly outside of the intent of DOD/Congress. Has anyone gotten any feedback from that level about what their thoughts on the Dept of the Navy's complete destruction of the mandated timeline goals?

I'm in the same boat right now. PEB received VA ratings on Nov 18. With the holiday season upon us, I do not expect to be notified until late January.

Yeah, mine were sent to the PEB on Nov. 22nd. Doubt we’ll see anything for a while.

UPDATE:
Called the PEB today at 202-685-6422. I had been trying for 2 days with no answer.

Received proposed disposition of 40DOD/90VA, permanent disability retirement. I accepted the findings and they have been forwarded back to the PEB prior to the end of the work day.

This is essentially the best case scenario I could have received. I spoke with PEBLO and MMSR-4 who advised the following.
PEB is turning around the index in ~3-5 days to MMSR-4 (per PEBLO)
MMSR-4 is turning index around in 1 business day (per MMSR-4)
EAS date will be assumed to have terminal and and 20 days PTAD in it, but is on the command to grant it.
EAS date can be adjusted earlier very easy by MMSR-4, but very difficult to extend it.

EAS has posted for 30 March. I have 20 days of PTAD that will be granted and ~50 days of leave on the books. Ive already completed 90% of my check out. Will likely take 10 or so days of terminal and sell the rest back.
