March 20 : refereed for a med board decision for major depression and anxiety disorder
march 27 : Co denies Ides going through Ldes i sign off

So im wondering if anyone can help me out with some questions i have how long does it usually take for a Ldes med board take while active duty its been 3 weeks and its just been very silent if it helps my Co and the Va mental health said that i am not fit for full as of my mental state right now also will i still be able to claim 100% of my Gi bill even though ive been in less then 3 years any help is appreciated
 
I don’t know enough of your situation to give you solid answers...but from an outside perspective with little inside knowledge, I think the Co can not legally deny you IDES.

Please see page 15 of the DODI 133218.

I would highly encourage you to seek legal advice from the Disability lawyer or JAG as soon as you can.

I must retract my last post. I didn’t see you are Navy. My opinions on my last post are for Army.

the DODI is Department of Defense wide guidance, but the Navy has their own specific rules and guidance. Hopefully a Navy person that has specific Navy knowledge can chime in.

I still suggest to seek legal counsel ASAP.

to my knowledge only the service member can elect the LDES route. This decision has to be approved by the CO. I do not believe LDES can be command directed. Speak to your legal rep ASAP!! Where are you stationed?
 
I think the CO denied Legacy system, not IDES.

I completely agree with chaplaincharlie. Highly encourage you to go to the IG and JAG ASAP!
 
I have a fact, a recommendation, and a speculation for you, in that order:
Fact - Only the service member can waive the right to IDES enrollment. Period. Up until last year I was involved in hundreds of these boards annually.
Recommendation - Recommend you discuss with IDES legal, then respectfully present the regulation they'll give you to your CoC.
Speculation - I would assume good faith personally unless the above recommendation does not resolve the issue; it's very common for Commanders to make bold statements/assumptions without knowing the regulation well.
