Seeking Mental Health While Also Going Through Admin Sep

Hey all, 11 year AD AF here, prior E that went to O. Have less than 5 years since commissioned so no special board for me.

I got an Art 15 for something relatively minor last year and they decided to recommend me for admin sep. That process apparently takes a long time for Os, but when the hammer comes down my understanding is I'm out in less than 2 weeks. I'm expecting for the SECAF to concur with the recommender's decision. Wonderful. However, I've been seeing mental health for a few months now for PTSD related to over a dozen deployments from what I was an E and May is my 365-day mark of seeing them. The medical group says they are 100% supportive of an MEB at that point based on my records, which would be great for me and I feel is warranted based on what I have going on. However, there is a good chance that this whole admin sep process concludes prior to that point. My provider believes that if I'm in an intensive outpatient program when that hammer drops, that they will not be able to separate me until that concludes, making it so I make it to the year mark to trigger the med board. Does anybody know if there is truth to that?

On a separate note, he also was going to attempt to convince the med group to give me a code 37 prior to the actual med board starting, knowing that they will start a med board as soon as im unfit for retention (a year in treatment and not expected to improve) according to the AFMSD. That would pause any sort of admin sep procedures from finalizing as far as I'm aware while that code is up. Anybody know if that is a thing that can be done?

Look, you have everything to gain by going to treatment and hopefully getting an MEB started. No one on here is judging anyone about your circumstances. Your MH and you getting better is all that matters. Get your treatment and go forward with trying to get the MEB going, sounds like you have a good case.

I do not know exactly how the dual process works, so I will defer to someone else on that part.

I’ve been steadily focusing on my treatment since last and will continue to as long as I’m able to.

I’m familiar with dual chapter and how that goes, I was mostly wondering if being in active intensive treatment will pause an admin separation before an MEB starts or if I have to push for that code 37.

It is not necessarily what type of treatment you are in; rather it is your prognosis (or expected prognosis) status at the one year mark. This is the time where the military MH provider should be able to determine your prognosis, regardless of administrative separation processing. If he feels you do not and will not meet retention standards IAW 48-123 by May, then he absolutely should be moving forward with recommending an MEB and getting the process started. However, ensure the administrative side of the house is notified of the situation, so they do not finalize administrative separation process.

If you have an attorney for the admin separation, they might be able to answer this or call the MEB/PEB legal office and see if they have an answer (or can help you get a MEB started).

This is a common misunderstanding. They are not suppose to wait until the 1 year mark, unless they fully believe you are on track to make the recovery by 1 year. If they can determine now you will not be able to meet retention standards by the 1 year mark, they should start the IRILO process now.

You should have a code 31 on your profile right now. The treatment will not necessary help hold up the admin separation, until they determine you need an MEB. What will help move it forward is for your MH provider to put in the notes the prognosis and state whether or not they feel you will meet retention standards with continued treatment by the 1 year mark. If the MH provider does not feel you will be good to go, he should be talking with the PCM to start the process now. The MH provider can start by writing up the MH NARSUM.
 
Spoke with my mental health provider The DAWG here is not willing to submit anything prior to the month of the 365 (May), despite them saying I will not be good to go at that point. Sucks.

How would an attorney be able to apply pressure to this situation to get a med board started? It doesn’t seem like there is much they can do to force their hand. I also don’t want to burn any bridges with my provider, as they’ve been a great advocate for me.
 
The DAWG may not be on track with reality. I suggest you talk to free,service provided, legal counsel.
