AFBCMR changed discharge to "secretarial authority"?

Yeah maybe that'll be more beneficial to create my own thread thanks. But I am going to be using the hagel/kurta memo. Due to the face that I have service connected PTSD that is SC to date of discharge I was given 70% for PTSD after discharge. So due to that they'll have to waive the 3yr limitations. I have already applied with NVLSP currently at attorney review records stage.
 
Do you feel that the JFF code fits your situation? Just asking, because that was how they handled my first case. I kept at it though, because it didn't fit for me, and I ended up getting it upgraded to a medical retirement. I'm hearing that JFF is mostly what they are upgrading people with who got caught up in don't ask, don't tell bad paper discharges. It's a non punative discharge. It shouldn't cause any problem for someone trying to re-enlist.
I have been upgraded to secretarial authority from personality disorder as well from a sexual assault. The jfx changed to jff and my honorable character stayed the same. However im not recieving any medical or disability for it and i have a re-enlistment code of 2c that recruiters wont touch and i dont think its fair. Either allow me to re-enlist or pay me for the trauma caused by the air force. Argh

Similar situation. Stellar infantry marine until MST happened. Diagnosed PTSD, harassed every day until discharge. Was up for medical discharge, but 1st Sgt delayed process (told me the paperwork was messed up and would take another 6-12 months)…popped for drugs after that. OTH.

Took 17 years and a number of legal battles to get General discharge. Now, 100% PT. But still reason states “misconduct” vs medical. Should have been medical from day one.

BCNR claim has been in place in summer. No idea how to contact them for status, but I have found a ton of other related info (process, timing, results, etc).

Wondering if anyone has a way to contact a live person through phone, email, etc with the BCNR?

I was finally granted medically retirement after an administrative discharge in May 2013. My case was filed in 2017 received and processed in 2019, adjudicated July 2021. I was referred back to the IDES process. I received my permanent medical retirement orders May 2022. I was retroactively medically retired with 70%, my DD 215 shows changes in item 9, 23, 25, 26, 27, and 28. I also was awarded 60% CRSC as well as received a remission for recoupment of my SRB.

Wow that is great could you give me some info on your discharge? What did you get out form I am trying to fight for this as well. I believe the time to wait is now shorter I’ve read there are lawsuits in place regarding the time the boards have been taking to send back answers as it holds us back from having benefits to us at an earlier date even with backpay it’s just added stress.

Did you mean what did type of discharge I had originally? I was administratively separated for misconduct.

the original discharge was for misconduct. I was going through a medical board prior to the incidence. The medical board was never sent to the Physical Exam Board for review/rating. My medical board was in 2012/2013, I counted heavily on AR 40-501, AR 635-40. The commanding general made the decision to separate me without having a complete packet. (Results from the PEB, fit for duty memorandum). Needless to say, I did hire an attorney after my first request was denied. It was worth it. Now I have a retiree id card, tricare for life and was granted combat related special compensation for most of my injuries. God's speed to you.

That's great. And yeah Im assuming the only thing we can do is fight for what is rightfully ours. And use regulations to our advantage.

Absolutely, There are some injustices that are corrected. It was well worth it for my peace of mind. I thought I was a good soldier. Unfortunately, my chain of command didn't see my value, they allowed their personal opinions to dictate their decisions. But in the end justice prevailed. I knew what they were doing was not according to the regulations however, I had no support from anywhere until I was discharged. They were always using my counseling to circumvent the system. As you can see, I ended up with benefits just as good if not better than had I retired with 20 years.

I’m trying to figure out why one would chose the times service if we have not much time inservice I served 4yrs misconduct discharge. currently 100% P&T for ptsd. And got a 70%ptsd rating 5months after discharge. I was seeing BH while deployed as well as prior and after and got back and self medicated. And got chaptered out. I was initially told I would get a ch 5-17. But with all my research I’ve done I should’ve been recommended for MEB once I got back from deployment. I know it’s gonna be a long fight but it’s worth it if I get tricare and medical retired on my dd214 as well as honorable discharge instead of general.

I didn't have a choice of the retirement calculator. I got medically retired once I submitted an application to the ABCMR. I submitted two applications, the first one was denied, the second only upgraded my discharge from general to honorable. I hired an attorney for the third application. They granted me partial relief and referred my packet back to the IDES process in San Antonio. They reviewed my packet and determined I should've been recommended for medical discharge. Once that was complete and my retired pay account was created, I had to apply for Combat Related Special Compensation (CRSC). So I don't get concurrent retirement pay as if I served 20 years or more.
I originally began the process in October 2014. The second application I went to the board in DC. I received the partial relief on July 31, 2021, I began working with my attorney in January 2017. One drawback (took a long time ) was getting my mental health records. I submitted my application for CRSC in August of 2022, the first one was denied because my retired pay account had not been created. I resubmitted and in about 45 days I received the results.

Okay so how did they calculate your CRSC payment? If you don’t mind sharing. And also look at this site. They want to give all combat injured vets full pay. Who knows how long it’ll take but there is a lot of major organizations backing it

I'm not sure what formula or regulation they use. My attorney did the application and the write up for that as well. I was granted 60% CRSA, nothing was granted for PTSD on the CRSC side, I can resubmit once I get my mental health records. The highest they will award is 75%. With all backpay and allowances (I think it caps at 6 years back pay). I got out May 2013. But they made everything retroactive to my separation date.
 
Yeah I understand that but what did your monthly CRSC payment come out too. I’ve seen people say they only have 400 or less and have 60% CRSC not sure how that works out I would think it’s more

Your CRSC will be the lesser (lower amount) of
— Longevity portion of retired pay
OR
—the amount found in the VA compensation tables for the approved CRSC percentage and number of dependents

So CRSC is calculated using longevity? What if the link I included is changed by law?
Please read my recent replies. I said CRSC is the lesser of the longevity OR the CRSC percentage in the VA comp tables.

The last approved change to CRSC computation was 1 January 2013.
