Hello,
My son will be going to college this fall and is using Chapter 35 benefits. We received a letter from the VA that was saying how he was almost 18 and was asking would he be in school. This was for the VA disability benefits, where you get benefits for each child. For some reason, I was thinking I read somewhere that you cannot get chapter 35 and the larger pay for a dependent in college. Is this correct? So on this chart, when my son turns 18 would he get $324.12 for him or no?

When your kid is getting chapter 35 benefits you can't get pay for them as dependent. If they weren't using chapter 35 but in school you could continue to get paid for them as a depending while they are attending college up to a certain age.

Ok, that is what I was thinking. So will they actually take away the 100 something that we get for him right now while once he turns 18?

yeah. You lose that when they turn 18 regardless. If they go to school you can add them back on while they are going to college. However, you can't do that if they are receiving chapter 35 benefits.

Are we sure that this is correct? I have a son in college using my Chapter 35 and VA is also giving me the additional $$ as a dependent. In fact, they sent me a letter last year to complete and then I received an updated claim letter showing that I would get the additional $$ until he graduates college.
I have two concerns: 1) Was there an additional document that I may have missed? Or did I miss a box that was supposed to be checked. 2) Now that he is going into his second year of college, when they catch it, that will be a significant debt that will be offset from future payments if this is correct.

There is a chapter 35 group on FB. I would join that and ask. I believe that is correct at least for kids. I don't think it applies to spouses.
