Separated today and got my DD214. I was on the promotion list for E-7 and my orders state I am to be retired as a SFC. My retirement certificate says SFC, but my DD214 says E-6. I argued with the personnel clerk and her boss that my DD214 should read E-7, but they weren’t having it. Are they right? If I’m right, what’s my recourse?

You need to go up higher than their boss. It makes no sense to have retirement orders with your rank not match your DD214. If you don't get it fixed ASAP you would have to submit a BCMR which can take years and is a pain the rear. Honestly, if that was the only option I wouldn't even bother with it since there is no monetary gain.

Talk to JAG. Also, call HRC or equivalent. I am miffed on why they would think that your DD214 shouldn't match your DD214 LOL. You are supposed to have your rank changed on the last day of your service and that should be reflected on your DD214.

One more thing! It may be something simple such as missing orders to change your rank. I would think it would be the retirement orders but normally there are orders to change your rank. So either they never run into it and your retirement orders are enough to change the rank or they need seperate retirrement orders stating the last date you are in it should be changed. Regardless of the answer to that going to higher ups and even IDES JAG should help.

Yea, in my experience the people whose job it is to know the law, regulation, or policy are clueless. Find the regulation or policy that covers your situation and show it to their supervisor. If that doesn’t work talk to the IG to help you. In most cases the IG is a useless avenue for Individual soldier needs (I was an IG for a long time) but sometimes you get lucky. Can’t tell you how many times I had to educate DFAS on how to read military regulations that cover pay for service members. Don’t assume these people know their job. You are your only best advocate.
 
@RangerVic Unfortunately you are so right about your comment saying that the people whose job it is to know the law, regulation, or policies are clueless. Everyone needs to know this and educate themselves on **everything**. I cannot tell you how many JAGs I have talked with that tell me something different. Or even DFAS. It's hard to get a straight answer because they stay in a box and don't try to perfect their job to help military service members. After I get out in April I plan on writing on here and letting everyone know my experience and what has happened during my process and how it actually works/worked. They know the basics and nothing else. I can't say that for everyone because I'm sure some go above and beyond, but just not from my experience so far.
