DA 199 Final for PEB

Hello all: I am looking for guidance and information. I have been going through the MEB process and here is where things stand. I was injured during OIF III 04-05. VA currently has me at 80% and 100% IU. 50 % PTSD, 40% back, 20% neck and 20% left shoulder.
MEB initially placed me on TDRL 2009 at 75%. The final PEB and DA 199 is as follows: PTSD 50%, left arm nurothopy 10% and neck 10% for total of 60%.
I realize that 60% is well above the 30% required for benefits , but the final PEB finding does not accurately reflect my conditions. Any and all help would be great. Thanks Dave
 
So 60% DoD and VA IU?
Does the drop from 75% to 60% change your finances? Is it all combat related?
 
It seems like a "fit" finding to put you back in to go over 20 isn't going to happen. Have you looked into Guard specific options of taking an early retirement if available? It may not be better to go that route if available, but some ideas to look into. With the CRSC glitch, if the 15% DoD difference has little to no effect, it might be wise to just take it and be done with the stress. If it makes(or could make) a drastic difference, then fight for what you can prove and feel you deserve. Just my two cents because life after the process if a big weight off the old spine(no pun intended for your condition).

I would run it by ADC/JAG and see what they think. Also, if you haven't already, look into SSDI to supplement if you need/warrant it.

Worst case your retirement continues and you don't have to wait until 60. CRDP would be nice, but without 20 years active, you'd have to wait until 60 for concurrent receipt anyhow.

Thanks for your input I'll try to speak with a jag in the am. This has been a long and trying journey, and I would so like it to be over but it rankles me that they can low ball some of the injuries just to lower the % for their benifit.

It's frustrating and hard not to take it personally. Ultimately, they make mistakes, potentially blatantly, but you and I aren't going to fix it(the system) by "mandating" we receive the appropriate percentage we deserve. It took me plenty of time to come to that realization; my wife had to shake some sense into me and also "wise counsel." Keep it simple and do what is best for you. Let "them," the big wigs fix the problems, but fight for you.
